floor space. <br /> C. No retail marijuana establishment shall operate as an outdoor or transient retailer, <br /> vendor or peddler, or as any temporary or accessory use. <br /> D. The distances described in subsection A above shall be computed by direct <br /> measurement in a straight line from the nearest property line of the land used for the <br /> purposes stated in subsection A above to the nearest portion of the building or unit in <br /> which the retail marijuana establishment is located. <br /> E. Medical marijuana businesses and retail marijuana establishments are subject to the <br /> following shared licensed premises and operational separation requirements: <br /> 1. A medical marijuana center that does not authorize patients under the age of 21 <br /> years to be on the premises, may also hold a retail marijuana store license and <br /> operate a dual retail business operation on the same licensed premises. In such <br /> case the medical marijuana center licensee must post signage that clearly <br /> conveys that persons under the age of 21 years may not enter. Under these <br /> circumstances and upon approval of the local and state licensing authorities, the <br /> medical marijuana center and the retail marijuana store may share the same <br /> entrances and exits, and medical marijuana and retail marijuana may be <br /> separately displayed on the same sale floor. Record keeping for the business <br /> operations of both must allow the local and state licensing authorities and City <br /> to clearly distinguish the inventories and business transactions of medical <br /> marijuana and medical marijuana-infused products from retail marijuana and <br /> retail marijuana products. <br /> 2. A medical marijuana center that authorizes medical marijuana patients under <br /> the age of 21 years to be on the premises is prohibited from sharing its licensed <br /> premises with a retail marijuana establishment. The two shall not be co-located <br /> in this instance and shall maintain distinctly separate licensed premises; <br /> including, but not limited to, separate retail and storage areas, separate <br /> entrances and exits, separate inventories, separate point-of-sale operations, and <br /> separate record-keeping. <br /> 3. Co-located licensed operations shall be operated in accordance with all <br /> applicable state and local, rules and regulations. <br /> Sec. 5.11.090. Persons prohibited as licensees; background checks. <br /> A. A license shall not be issued to or held by any person contrary to C.R.S. § 12-43.4- <br /> 306 and the rules and regulations promulgated by the State of Colorado. <br /> B. In investigating the qualifications of an applicant, licensee, owner, or manager of a <br /> retail marijuana establishment, the local licensing authority shall make a finding and <br /> determination as to the good moral character and criminal history of such persons in <br /> accordance with the standards and procedures set forth in the Colorado Retail Marijuana <br /> Code and the rules and regulations promulgated thereunder.
