same for any marijuana or marijuana product either free or at a discount. <br /> B. It shall be unlawful for a retail marijuana store: <br /> 1. To sell or give away any consumable product, including but not limited to, <br /> cigarettes, alcohol, or edible products that do not contain marijuana (e.g., soda, <br /> candy, and baked goods). <br /> 2. To sell retail marijuana or retail marijuana products over the internet or to <br /> deliver marijuana or marijuana products to a person not physically present in <br /> the licensed premises. <br /> C. It shall be unlawful for any person to engage in any form of business or commerce <br /> involving the cultivation, processing, manufacturing, storage, sale, distribution or <br /> consumption of retail marijuana other than those forms of businesses and commerce that <br /> are expressly permitted by Amendment 64, the Colorado Retail Marijuana Code, and this <br /> Code. <br /> Sec. 5.11.220. Visibility of activities; control of emissions. <br /> A. All activities of retail marijuana establishments, including, without limitation, <br /> processing, displaying, selling and storage, shall be conducted indoors. <br /> B. Sufficient measures and means of preventing smoke, odors, debris, dust, fluids and <br /> other substances from exiting a retail marijuana establishment must be provided at all <br /> times. In the event that any odors, debris, dust, fluids or other substances exit a retail <br /> marijuana establishment, the owner of the subject premises and the licensee shall be jointly <br /> and severally liable for such conditions and shall be responsible for immediate, full clean- <br /> up and correction of such condition. The licensee shall properly dispose of all such <br /> materials, items and other substances in a safe, sanitary and secure manner and in <br /> accordance with all applicable federal, state and local laws and regulations. <br /> Sec. 5.11.230. Disposal of marijuana byproducts. <br /> The disposal of retail marijuana, byproducts and marijuana accessories shall be done in <br /> accordance with the Colorado Retail Marijuana Code and any other applicable state and <br /> local laws, ordinances and regulations. <br /> Sec. 5.11.240. Sales and use tax. <br /> Each licensee shall collect and remit city sales and use taxes on all retail marijuana, retail <br /> marijuana products, marijuana accessories and other tangible personal property sold, <br /> dispensed, used or purchased at the retail marijuana establishment, in accordance with the <br /> requirements of chapter 3.20 of this Code. <br /> Sec. 5.11.250. Inspection of books and records and licensed premises. <br /> A. Each licensee shall keep a complete set of all records necessary to show fully the <br /> Ordinance No. 1649, Series 2013 <br /> Page 15 of 20 <br />
