ORDINANCE NO. 1650 <br /> SERIES 2013 <br /> AN ORDINANCE AMENDING TITLE 17 OF THE LOUISVILLE MUNICIPAL <br /> CODE TO ADOPT REGULATIONS REGARDING RETAIL MARIJUANA <br /> ESTABLISHMENTS <br /> WHEREAS, Article XVIII, Section 16 of the Colorado Constitution, referred to as <br /> Amendment 64, was approved by Colorado voters in November 2012; and <br /> WHEREAS, Amendment 64 legalized the private use of marijuana for persons <br /> twenty-one years of age or older; and <br /> WHEREAS, the Governor on May 28, 2013 signed into law House Bill 13-1317 <br /> (HB 13-1317) which provides guidance for local governments to regulate retail marijuana <br /> establishments; and <br /> WHEREAS, Amendment 64 and HB 13-1317 outline multiple options for local <br /> municipalities from the outright banning of retail marijuana establishments to establishing <br /> detailed regulation and licensing requirements; and <br /> WHEREAS, the City of Louisville is a home rule municipal corporation, and in <br /> addition to the authority set forth in Amendment 64, HB 13-1317 and other state statutes, <br /> has authority pursuant to Article XX of the Colorado Constitution and the Louisville Home <br /> Rule Charter to establish zoning districts and zoning regulations regulating the use of land <br /> within the City; and <br /> WHEREAS, the Louisville City Council directed staff to develop a series of <br /> ordinances that will allow certain retail marijuana establishments as permitted land uses <br /> and license them with additional local licensing standards and regulations governing the <br /> time, place, manner, and number of retail marijuana establishments as authorized by <br /> Amendment 64, HB 13-1317, including without limitation provisions concerning such <br /> things as distance restrictions, restrictions on the size of retail marijuana establishments, <br /> minimum security measures, hours of operation, restrictions or requirements pertaining to <br /> deliveries, restrictions on signage, and standards that retail marijuana establishment owners <br /> and employees must satisfy; and <br /> WHEREAS, the Louisville Planning Commission, after notice by publication and <br /> a public hearing, has provided its recommendation to the City Council regarding the <br /> amendments to Title 17 of the Louisville Municipal Code concerning the matters <br /> addressed in this ordinance; and <br /> WHEREAS, by adoption of this ordinance, the City Council does not intend to <br /> authorize or make legal any act that is not permitted under federal or state law but rather to <br /> establish local regulations governing the location and use of land for retail marijuana <br /> establishments; and <br /> 1. <br />
