3. within Downtown Louisville as defined by section 17.08.113 of this <br /> Code; or <br /> 4. within the Agricultural (A), Open Space (OS), Administrative Office <br /> Transitional (AO-T), Mixed Use (MU-R), Commercial Neighborhood <br /> (CN) zone districts, or any other zoned area in which the retail <br /> marijuana establishment is not a permitted use. <br /> C. No licensed premises for a retail marijuana store shall, at the time it is <br /> established and first licensed by the city, be located in a physical space <br /> exceeding two thousand (2,000) square feet of leasable floor space, nor shall <br /> such a licensed premises ever exceed two thousand (2,000) square feet of <br /> leasable floor space. The maximum physical space occupied by any medical <br /> marijuana business and retail marijuana establishment sharing premises shall <br /> never exceed three thousand eight hundred (3,800) square feet of leasable floor <br /> space. <br /> D. No retail marijuana store or retail marijuana testing facility shall operate as an <br /> outdoor or transient retailer, vendor or peddler, or as any temporary or <br /> accessory use. <br /> E. The distances described in subsection B above shall be computed by direct <br /> measurement in a straight line from the nearest property line of the land used <br /> for the purposes stated in subsection A above to the nearest portion of the <br /> building or unit in which the retail marijuana store or retail marijuana testing <br /> facility is located. <br /> Section 6. Section 17.72.090 of the Louisville Municipal Code is hereby <br /> amended by the addition of a new subsection B.21, to read as follows: <br /> 21. Retail marijuana stores and retail marijuana testing facilities. <br /> Section 7. Upon the effective date of this ordinance, and until December 31, <br /> 2014, but except as provided in Ordinance No. 1648, Series 2013, no application or request <br /> for a change in location of premises shall be received, reviewed, approved, or otherwise acted <br /> upon, and any license issued pursuant to this ordinance shall be limited to use at the premises <br /> specified in the application for such license. <br /> Section 8. Any person who violates any provision of this ordinance shall be <br /> punished by a fine of not more than the maximum fine set forth in section 1.28.010.A of the <br /> City Code or by imprisonment not to exceed one year, or by both such fine and imprisonment. <br /> Each day during any portion of which any violation of any provision of this ordinance is <br /> committed, continued,or permitted by any such person shall be a separate offense. <br /> Section 9. If any portion of this ordinance is held to be invalid for any reason <br /> such decisions shall not affect the validity of the remaining portions of this ordinance. The <br /> 5 <br />
