He asked if there are provisions that the land <br />restored to its original state. <br /> <br />Deputy City Manager Boyd stated it is a requirement of the easement document. Public <br />Works Director Tom Phare confirmed Public Service would not change the use of the <br />property. <br /> <br />PUBLIC COMMENTS ON ITEMS NOT ON THE AGENDA <br /> <br />Cliff Monet, representing the American Legion Post 111, 1150 Pine Street, Louisville, <br />CO, asked Council to consider amending Ordinance No. 1396, Series 2002 to exempt <br />private clubs. He stated that, after consulting an attorney, they believe clubs are exempt, <br />but wish to make the exemption official. He explained private clubs are not open to the <br />pubic and admission to the facility is by access card or with permission of a member or <br />staff. He noted the ordinance defines establishments licensed as hotel/restaurant, or <br />tavern, under the liquor laws of the State of Colorado; however, the American Legion <br />holds a Club License and is a non-profit, volunteer organization. He explained many of <br />the members are veterans of retirement age, who have smoked for many years, and if <br />they are prohibited from smoking in Louisville, they will frequent other smoker-friendly <br />veterans lounges. He asked Council to amend the ordinance to exempt private clubs. <br /> <br />Council member Mayer arrived at 7:10 p.m. <br /> <br />COUNCIL INFORMATIONAL COMMENTS ON PERTINENT ITEMS NOT ON <br /> THE AGENDA <br /> <br />Sisk reported that on Saturday, November 30th, the Monarch High School football team <br />won the 4A State Championship. He explained it is the first state championship in <br />Boulder County in ten years. He stressed it was the result of a lot of work and effort by <br />the Monarch football team, Coach Bill Bravo, his staff, the school, and the entire <br />community. He reported Warrior field at Centaurus High School, had the largest recorded <br />attendance for a state championship football game. He asked Council to recognize the <br />Monarch High School football team and the school, for the State Championship. <br /> <br />Davidson voiced his belief private clubs should be exempt because they are self- <br />regulating. <br /> REGULAR BUSINESS <br /> <br />2003 BUDGET - PUBLIC HEARING (published Daily Camera November 30, 2002) <br /> <br /> <br />
