<br />RESOLUTION NO. 36 <br />SERIES 1992 <br /> <br />A RESOLUTION ESTABLISHING THE POLICY FOR PROVIDING ADEQUATE PARKS, <br />TRIALS, AND OPEN SPACE IN THE CITY OF LOUISVILLE, COLORADO. <br /> <br />WHEREAS, the people of the City of Louisville, Colorado need and desire parks and open <br />space; and, <br /> <br />WHEREAS, land dedication of a minimum of 12 percent or equivalent cash is required <br />during the annexation process; and, <br /> <br />WHEREAS, the City Council of the City of Louisville, Colorado wishes to clearly establish <br />its goal of providing for adequate parks, trails, and open space; <br /> <br />NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Louisville, <br />Colorado establishes the following policy for land dedication or equivalent cash in residential <br />annexations: <br /> <br />1. Each annexation will be considered on a case-by-case basis. <br />2. Retention ponds or other land left open solely for the purpose of the development, <br />such as land under power lines, will not be considered as part of the required land <br />dedication of a minimum of 12 percent. <br />3. Cost of maintenance of the land will be a consideration in determining if land or the <br />cash equivalent is desired, but the overriding consideration will be the benefit that <br />could be derived from the dedication of the land to the neighborhood and the <br />people of the City. <br />4. In general, land for open space, future trails, and parks is preferred in residential <br />annexations over cash. <br />5. Pocket parks in areas that do not have easy access to other parks, although more <br />expensive to maintain, should not be excluded from development plans solely on a <br />maintenance costs basis without review by the Planning Commission. <br />6. City policy for land dedication or equivalent cash is established only by the City <br />Council, with recommendations by the Planning Commission, and city staff. <br /> <br />BE IT FURTHER RESOLVED, city staff is specifically directed to use this established policy <br />in all current and future residential annexations and to seek additional guidance from the City <br />Council when and if further clarification is required. <br /> <br />PASSED AND ADOPTED this 19th day of May, 1992. <br /> <br />~-0~ <br /> <br />Tom Davidson, Mayor <br /> <br />ArrEST: <br /> <br />~mper, c' <br /> <br />
