Board of Adjustment <br />Meeting Minutes <br />November 20, 2013 <br />Page 3 of 4 <br />• Home is 23.5 feet from property line, however the columns of the deck are <br />measured to 19 feet from the property line. <br />▪ The application complies with the 6 criterion established for a variance and <br />therefore should be approved. <br />Questions from Board to Staff: <br />No questions <br />Applicant Presentation and questions from the Board to the applicant: <br />No presentation was received by the applicant, John Kostoff. <br />Public Present in Opposition of Application: <br />None heard. <br />Public Present in Favor of Application: <br />None heard. <br />Greg Ralston, owner of properties on both side of the affected property, inquired if all <br />life safety elements were reviewed at time of building inspection. He added he wanted <br />to make sure there weren't any outstanding issues in existence if this were to be <br />approved. He was worried how this might affect his property values. <br />Russ stated there weren't any life safety issues involved with this structure. <br />Jasiak asked if there were any safety issues involved with setbacks. <br />Russ stated setbacks are primarily for neighborhood character. <br />Jasiak moved and Stuart seconded to close the hearing. Motion passed unanimously <br />by voice vote. <br />Public Hearing Close /Board iscussion: <br />Stuart stated the report was well structured and saw the mistake made by staff. He was <br />assured it wouldn't happen again. He stated he agrees with staffs assessment of the <br />criteria. <br />Jasiak stated he does not find any detrimental impacts and believes this is not so <br />egregious as to require the removal of the structure. He believes the character of the <br />neighborhood is not affected. <br />Ewy stated she agrees /and feels as though they can still park in the driveway without <br />blocking any public circulation on the sidewalk. <br />Niska believes it fits within the neighborhood. <br />Borrman stated he agreed with the other board members. <br />Jasiak moved and Ewy seconded to approve the variance request. <br />Roll Call Vote: <br />Chris Fuller, Chair <br />Recused <br />Erik Jasiak <br />Yes <br />
