Special Meeting Minutes
City of Louisville City Council &
Town of Superior Board of Trustees
December 16, 2013
Mayor Pro Tern Cirelli did not feel big empty box stores would help either community; it
would either be something productive or nothing. He noted both communities share the
same desire to maximize the sales tax revenue for this project.
Mayor Pro Tern Dalton stated he did not feel a hotel fits the description of a retail store.
There was discussing of the City lodging tax Mayor Pro Tern Cirelli explained the Town
of Superior could not pass a lodging tax because they are not a home rule city.
Mayor Andrew Muckle stated the Town of Superior feels comfortable the development
meets the requirements of the IGA.
Mayor Robert Muckle inquired about the total square footage for the proposed hotel.
Mayor Andrew Muckle stated 225,000 square feet is proposed.
Council member Lipton inquired what type of hotel is proposed for the site. Mayor
Andrew Muckle stated the Town is not dictating a type of hotel.
Council member Lipton inquired if the hotel would have conference facilities and if so,
would the Town collect retail sales tax. Mayor Andrew Muckle stated it would depend
on whether the hotel wanted the Town to operate the conference space, but generally
hotels operate their own facilities. Council member Lipton stated it would depend upon
the hotel's business model.
Council member Lipton stated he assumed there would be a restaurant or other
services, such as a spa, and Mayor Andrew Muckle stated there is not a development
application before the Board.
Council member Stolzmann agreed there are certain components of hotel services that
pay a retail sales tax but commercial use was not written into the IGA, retail generated
sales tax was written into the IGA.
Mayor Pro Cirelli stated the Town is interested in getting the most viable development,
which will generate as much sales tax revenue as soon possible. This may depend on
the type of mixed use needed in the area. There may not be a need for a big box store,
which may remain empty. They are trying to make something viable and generate as
much income as possible for both communities. He stressed the Town Center has
some flexibility, which has benefits and will comply with the agreement.
Mayor Pro Tem Dalton stated no one is suggesting a big box store. He stated if the
Town needed flexibility, why wasn't there discussion on an amendment to the IGA. He
stated the IGA specifically outlines 250,000 square feet of retail generated sales tax.
