RESOLUTION NO. 22 <br />SERIES 2007 <br />A RESOLUTION APPROVII\fG A REIMBURSEMENT AGREEMENT WITH <br />COLORADO TECH CENTER METROPOLITAN DISTRICT <br />WHEREAS, the Colorado Tech Center Metropolitan District (the "District") previously <br />constructed a lift station to serve a portion of the property located within the District's <br />boundaries; and <br />WHEREAS, the existing lift. station was constructed by the District and dedicated to the <br />City for operation and maintenance; ;end <br />WHEREAS, the District desires to replace and expand the existing lift station in a new <br />location and extend other certain gravity sewer and force main line improvements as further <br />described in the Reimbursement Agreement (the "Project"); and <br />WHEREAS, upon completion and acceptance by the City, the Project will be o.vned and <br />operated by the City; and <br />WHEREAS, the Project, in addition to serving properties located within the District, may <br />serve certain properties located without the current boundaries of the District; and <br />WHEREAS, the parties have agreed to terms wherein the District will impose a portion of <br />costs incurred by the District related to the design, construction and installation of the project on a <br />prorated basis on those properties benefits°d by the Project but not within the District, and the City <br />will assist the District in collecting such re-imbursements from such benefited properties; and <br />WHEREAS, the City is authorized to enter into such agreement pursuant to state Iaw, <br />including but not limited to the Colo. Const. Art. XN, Section 18(2)(a), and C.R.S. Sections 29- <br />1-203. <br />NOW, THEREFORE, BE liT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF LOUISVILLE, COLORADO: <br />1. The proposed Reimbursement Agreement between the City of Louisville and the <br />District is hereby approved in essentially the same form as the copy of such Agreement <br />accompanying this Resolution. <br />2. The Mayor is hereby authorized to execute the Agreement on behalf of the City <br />Council of the City of Louisville, except that the Mayor is hereby granted the authority to negotiate <br />and approve such revisions to said Agreement as the Mayor determines are necessary or desirable <br />for the protection of the City, so long as the essential terms and conditions of the Agreement are not <br />altered. <br />PASSED AND ADOPTED this 17th day of April 2007. <br />
