RESOLUTION NO. 22 SERIES 2007 A RESOLUTION APPROVII\fG A REIMBURSEMENT AGREEMENT WITH COLORADO TECH CENTER METROPOLITAN DISTRICT WHEREAS, the Colorado Tech Center Metropolitan District (the "District") previously constructed a lift station to serve a portion of the property located within the District's boundaries; and WHEREAS, the existing lift. station was constructed by the District and dedicated to the City for operation and maintenance; ;end WHEREAS, the District desires to replace and expand the existing lift station in a new location and extend other certain gravity sewer and force main line improvements as further described in the Reimbursement Agreement (the "Project"); and WHEREAS, upon completion and acceptance by the City, the Project will be o.vned and operated by the City; and WHEREAS, the Project, in addition to serving properties located within the District, may serve certain properties located without the current boundaries of the District; and WHEREAS, the parties have agreed to terms wherein the District will impose a portion of costs incurred by the District related to the design, construction and installation of the project on a prorated basis on those properties benefits°d by the Project but not within the District, and the City will assist the District in collecting such re-imbursements from such benefited properties; and WHEREAS, the City is authorized to enter into such agreement pursuant to state Iaw, including but not limited to the Colo. Const. Art. XN, Section 18(2)(a), and C.R.S. Sections 29- 1-203. NOW, THEREFORE, BE liT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LOUISVILLE, COLORADO: 1. The proposed Reimbursement Agreement between the City of Louisville and the District is hereby approved in essentially the same form as the copy of such Agreement accompanying this Resolution. 2. The Mayor is hereby authorized to execute the Agreement on behalf of the City Council of the City of Louisville, except that the Mayor is hereby granted the authority to negotiate and approve such revisions to said Agreement as the Mayor determines are necessary or desirable for the protection of the City, so long as the essential terms and conditions of the Agreement are not altered.
