<br />2. The new Sewer Agreement attached hereto and incorporated <br />herein by this reference which, in part, rescinds the 1982 sewer <br />agreement, is approved and the Mayor is authorized and directed to <br />execute the new Sewer Agreement on behalf of the City of <br />Louisville, subject to the condition described in paragraph 4 of <br />this Resolution. <br /> <br />3. The City Attorney is hereby directed to take all action <br />necessary or appropriate for dismissal, with prejudice, each party <br />to bear its own costs and attorney fees of the case of Town of <br />Superior. Colorado v. city of Louisville. Colorado. et al., <br />Colorado Court of Appeals Case No. 90CA1443 and Boulder District <br />Court civil Action No. 89CV587, subject to the condition described <br />in paragraph 4 of this Resolution. <br /> <br />4.
