City Council <br /> Meeting Minutes <br /> January 21, 2014 <br /> Page 15 of 30 <br /> permitted through an engineered solution mutually approved by the Louisville Fire <br /> Protection District and the City of Louisville (with input from Public Works, Police, and <br /> Planning Departments) where compliance with the following criteria are demonstrated: <br /> 1. Specific access and loading needs of the Louisville Fire Protection District <br /> vehicles are met; <br /> 2. Staging and firefighting capabilities of the Louisville Fire Protection District are <br /> not compromised; <br /> 3. Pedestrian and bicyclist visibility by motorists is enhanced; <br /> 4. Pedestrian and bicyclist exposure to vehicle traffic is reduced; <br /> 5. A safe driving environment through management of roadway design speeds <br /> is promoted; and, <br /> 6. Adequate emergency egress and evacuation capabilities based on the design <br /> and density of the development. <br /> City Manager Fleming proposed Council consider a second reading amendment to the <br /> ordinance, which would clarify the intent and would provide the City Council the ability to <br /> approve waivers. He suggested the following amendment: <br /> B. Design alternatives to Appendix D, Fire Apparatus Access Roads, may be <br /> permitted only if City Council approves a waiver through an engineered solution <br /> mutually approved by the Louisville Fire Protection District and the City of Louisville <br /> (with input from Public Works, Police, and Planning Departments). <br /> COUNCIL COMMENTS <br /> Council member Stolzmann addressed the current code, which includes the additional <br /> sentence: "In the event of any conflict between any provision of said Appendices D and <br /> any section of this chapter, the more restrictive requirement shall control". She asked <br /> how that sentence is less safe with respect to the fire code. <br /> Planning Director Russ explained the City is adopting a fire code that impacts the <br /> design of the roads. Prior to the Comprehensive Plan, the transportation policies <br /> specifically stated they wanted a balanced transportation system where motorists, <br /> transit customers, bicyclists and pedestrians have the rights to the roads and share the <br /> roads. Previously the roads were designed for a single user, now it's being designed for <br /> multiple users. Designing for the roads, but also moving people, improving the quality <br /> of the trip and providing land use solutions to manage traffic congestion. <br /> Planning Director Russ explained Chapter 16 deals with the design of the road and <br /> roadway safety. The default is on the consensus of experts on safety. He noted <br /> nothing in the criteria compromises fire safety. Chapter 15.12.120 - Fire lane <br /> specifications eliminates inconstancies with the Fire Code and Chapter 16 of the LMC <br /> and eliminates the City ability to arbitrarily reduce the fire lane to 16 feet.
