City Council <br /> Meeting Minutes <br /> February 4, 2014 <br /> Page 25 of 28 <br /> OF LOUISVILLE AND THE COLORADO DEPARTMENT OF TRANSPORTATION <br /> FOR COMPLETION OF SEGMENT E OF PHASE II OF THE US 36 MANAGED <br /> LANE/BUS RAPID TRANSIT PROJECT—2nd Reading —Public Hearing —02/04/14 <br /> Mayor Muckle requested a City Attorney introduction. <br /> City Attorney Light introduced Ordinance No. 1658, Series 2014. <br /> Mayor Muckle opened the public hearing and requested a staff presentation. <br /> Parks and Recreation Director Stevens explained the Colorado Department of <br /> Transportation (CDOT) is planning to widen US36 from McCaslin Boulevard to 88th <br /> Street in Louisville. This is in connection with Phase II of the US 36 Managed Lane/Bus <br /> Rapid Transit Project. CDOT brought to the City's attention that CDOT owns Parcel <br /> 25Rev.X, identified on the Right-of-Way plan sheet, and the City of Louisville owns <br /> Parcel 8D as well as residual interests in Parcel 8E and 8F on the Right-of-Way plan <br /> sheet. CDOT maintains the area within Parcel 8D, 8E and 8F. The City of Louisville <br /> maintains the area within Parcel 25Rev.X. <br /> In order to clear title and align the ownership with each respective area, CDOT requests <br /> a land exchange. If the exchange of interests cannot be approved through Ordinance <br /> No. 1658, Series 2014, CDOT will exercise its power of eminent domain for Parcel 8D <br /> as this parcel is necessary to complete CDOT's project. This transaction does not have <br /> a significant fiscal impact. Staff recommended the City Council approve Ordinance No. <br /> 1658, Series 2014, on second and final reading. <br /> COUNCIL COMMENTS <br /> Council member Stolzmann inquired whether the proceeds of the land would be set <br /> aside for open space acquisitions. Parks and Recreation Director Stevens stated the <br /> exchange of funds is less than $600.00. City Manager Fleming explained it is classified <br /> as street right-of-way rather than open space. <br /> Mayor Muckle inquired whether there was any objection to putting the money into the <br /> general fund. There was Council consensus to do so. <br /> Mayor Muckle outlined Segment E of Phase II of the US 36 Managed Lane/Bus Rapid <br /> Transit Project from Table Mesa to McCaslin Boulevard. The legislators had asked <br /> CDOT to delay the financial closure so they can better understand the Plenary Roads <br /> contract. <br /> Mayor Muckle requested public comment and hearing none, closed the public hearing. <br />
