Coal Creek Drive <br /> Superior, CO 80027 <br /> Re: Superior Town Center Planned Development Amendment <br /> City of Louisville — Additional Project Referral Comments <br /> Dear Beth: <br /> I wanted to follow-up on the June 3, 2013 letter I sent you and a subsequent <br /> meeting with Mayor Andrew Muckle, Mayor Bob Muckle, Superior Town Manager <br /> Matt Magley and myself. The meeting was beneficial and I believe we all have <br /> the same desire to meet the intent of the 1997 original and 2005 First <br /> Amendment to the Property Disconnection and Revenue Sharing <br /> Intergovernmental Agreement (IGA) between the Town of Superior and the City <br /> of Louisville. <br /> Subparagraph b of Paragraph 3 in the 2005 First Amendment to the IGA states: <br /> 'There shall be a minimum of 250,000 square feet of retail, sales-tax <br /> generating development on the South Property, Superior shall require <br /> construction of a minimum of 250,000 square feet of retail, sales-tax <br /> generating development on the South Property as part of its approval of <br /> the Preliminary PD/Zone District Plan for development on the South <br /> Property, and Superior shall not permit or approve any development that <br /> does not contain such minimum amount of retail, sales tax generating <br /> square footage." [emphasis added] <br /> Consistent with our previous comments, and to ensure compliance with the IGA, <br /> Louisville again requests that Superior include specific language setting out the <br /> IGA's requirements in the Preliminary PD/Zone District Plan for development on <br /> the South Property.
