Coal Creek Drive <br /> Superior, CO 80027 <br /> Re: Superior Town Center Planned Development Amendment Approval <br /> Dear Mayor and Trustees: <br /> On behalf of the Louisville City Council, this is to respond to Superior's recent <br /> approval of the Amendment to the Planned Development/Zone District Plan for <br /> the Superior Town Center Property (Plan Amendment). <br /> As Superior and Town Center developer are aware, the 80-acre "South Property" <br /> portion of the Town Center Property is subject to the 1997 Intergovernmental <br /> Agreement and 2005 First Amendment to Intergovernmental Agreement (IGA) <br /> between the Town of Superior and the City of Louisville providing for property <br /> disconnection and revenue sharing. Section 3(b) of the First Amendment to IGA <br /> states as follows: <br /> "There shall be a minimum of 250,000 square feet of retail, sales-tax <br /> generating development on the South Property. Superior shall require <br /> construction of a minimum of 250,000 square feet of retail, sales-tax <br /> generating development on the South Property as part of its approval of <br /> the Preliminary PD/Zone District Plan for development on the South <br /> Property, and Superior shall not permit or approve any development that <br /> does not contain such minimum amount of retail, sales tax generating <br /> square footage." <br /> Louisville understands the Plan Amendment as approved includes the following <br /> statement under Plan Sheet PI.0, Project Implementation — Rights and <br /> Obligations: <br /> 749 Main Street Louisville CO 80027 <br /> 303.335.4533 (phone) 1 303.335.4550 (fax) <br /> www.louisvilleco.gov <br />
