ORDINANCE NO.1654 <br /> SERIES 2014 <br /> AN ORDINANCE AMENDING SECTIONS 13.12.030 AND 13.12.040 OF THE <br /> LOUISVILLE MUNICIPAL CODE REGARDING TAP FEES CHARGED IN <br /> CONNECTION WITH AUTOMATIC FIRE-CONTROL SYSTEMS IN ALL NEW <br /> RESIDENTIAL UNITS, AND COMMERCIAL FIRE LINES <br /> WHEREAS, the City of Louisville is a Colorado home rule municipal corporation <br /> duly organized and existing under laws of the State of Colorado and the City Charter; <br /> and <br /> WHEREAS, after a duly noticed public hearing held January 7 and 21 and <br /> February 18, 2014, where evidence and testimony were entered into the record, the <br /> Louisville City Council adopted Ordinance No. 1652, Series 2013 adopting by reference <br /> the 2012 editions of the International Building Code, International Residential Code, <br /> International Mechanical Code, International Fuel Gas Code, International Energy <br /> Conservation Code, International Fire Code, International Plumbing Code, and the 2011 <br /> edition of the National Electrical Code adopted by the State; and <br /> WHEREAS, said codes establish a requirement for all newly constructed single- <br /> family dwellings in Louisville to install automatic fire-control systems; and <br /> WHEREAS, City Council's wishes to remove financial obstacles to the safe <br /> installation of required automatic fire-control systems in newly constructed single-family <br /> dwellings; and <br /> WHEREAS, a core value of the City in the 2013 Comprehensive Plan promotes: <br /> "A Healthy, Vibrant, and Sustainable Economy . . . where the City understands and <br /> appreciates the trust our residents, property owners, and business owners place in it <br /> when they invest in Louisville, and where the City is committed to a strong and <br /> supportive business climate, which fosters a healthy and vibrant local and regional <br /> economy for today and for the future.," and eliminating unnecessary fees associated <br /> providing safety features and services promotes a Healthy, Vibrant, and Sustainable <br /> Economy; and <br /> WHEREAS, a second core value of the City in the 2013 Comprehensive Plan <br /> promotes: "Safe Neighborhoods . . . where the City ensures our policies and actions <br /> maintain safe, thriving and livable neighborhoods so residents of all ages experience a <br /> strong sense of community and personal security", and furthering the installation of <br /> automated fire-control systems at the most affordable costs will ensure safer <br /> neighborhoods; and <br /> WHEREAS, the City Council further desires to amend Section 13.12.040 of the <br /> Louisville Municipal Code to expressly provide that tap fees are not charged for non- <br /> residential taps utilized solely for installation of fire lines and automatic fire-control <br /> systems; and <br />
