a new license, the Secretary shall determine, in consultation with the Planning and <br /> Building Safety Department, whether or not the proposed location complies with any and <br /> all zoning and land use laws (LMC Sec. 5.11.060) If the application is disapproved for <br /> these reasons, the Secretary shall notify the State. If the application is not disapproved, <br /> the Secretary shall notify the State Licensing Authority the application is awaiting further <br /> review by the Local Licensing Authority. The Authority Secretary will schedule a public <br /> hearing upon the application according to provisions in the Colorado Retail Marijuana <br /> Code and Louisville Municipal Code. Late applications will be scheduled for the next <br /> subsequent scheduled hearing. <br /> 5. The Authority Secretary will circulate the application to all affected departments within <br /> the City to determine compliance with any applicable laws, rules and regulations. <br /> 6. Submit all City fees to the Authority Secretary. Checks should be made payable to: <br /> CITY OF LOUISVILLE. Returned checks will be assessed an additional collection fee, <br /> and the hearing date may also be postponed. <br /> 7. The applicant or the applicant's representative must be present at the hearing to formally <br /> submit the application to the Authority. Failure to appear, or to request a continuance, <br /> may result in delay or denial of the application. <br /> The following is an outline of the order of events/procedures for retail marijuana <br /> establishment licensing: <br /> A. Complete and compile all required documentation and submit to the State of Colorado <br /> Marijuana Licensing Division (incomplete application forms will not be accepted). <br /> B. The State Licensing Division will forward the application to the Local Licensing <br /> Authority Secretary, who will set a public hearing date. <br />
