ORDINANCE NO. 1659 <br /> SERIES 2014 <br /> AN ORDINANCE EXTENDING THE TERMS OF A NONEXCLUSIVE FRANCHISE <br /> GRANTED BY THE CITY OF LOUISVILLE, COLORADO, TO COMCAST OF <br /> COLORADO I,LLC,AND ITS LAWFUL SUCCESSORS, TRANSFEREES AND <br /> ASSIGNS, FOR THE RIGHT TO MAKE REASONABLE AND LAWFUL USE OF <br /> RIGHTS-OF-WAY WITHIN THE CITY TO CONSTRUCT, OPERATE, MAINTAIN, <br /> RECONSTRUCT, REPAIR AND UPGRADE A CABLE SYSTEM FOR THE PURPOSE <br /> OF PROVIDING CABLE SERVICES TO CITIZENS WITHIN THE CITY <br /> WHEREAS, Comcast of Colorado I, LLC ("Comcast") currently holds a cable franchise <br /> ("Franchise") with the City of Louisville ("City"), granted by Ordinance No. 1488, Series 2006; <br /> and, <br /> WHEREAS, Comcast's Franchise was extended by Ordinance No. 1626, Series 2013 to <br /> expire on April 11, 2014; and another extension thereof has been requested; and, <br /> WHEREAS, Comcast has preserved its right of renewal by timely filing a request with <br /> the City to activate the formal process for renewing the Franchise pursuant to the provisions of <br /> the Cable Communications Policy Act of 1984 ("Cable Act"); and <br /> WHEREAS, Comcast and the City are currently in negotiations concerning renewal of <br /> the existing Franchise; and, <br /> WHEREAS, Comcast and the City anticipate that additional time will be needed to <br /> complete negotiations and for the City to consider a proposed franchise renewal, which the <br /> parties believe will take no more than six (6) months; and, <br /> WHEREAS, the City Council finds it is in the best interests of the citizens of the City to <br /> extend the term of the Franchise prior to its expiration to allow sufficient time for negotiations <br /> regarding a proposed franchise renewal and consideration thereof by the City; and, <br /> WHEREAS, Comcast has agreed to the extension of the Franchise as set forth herein; <br /> NOW, THEREFORE,BE IT ORDAINED BY THE CITY COUNCIL OF THE <br /> CITY OF LOUISVILLE, COLORADO: <br /> - <br /> Section 1. The term of the Franchise between Comcast and the City is hereby <br /> extended from its expiration date of April 11, 2014, for a period of six (6) months, to expire on <br /> October 11, 2014. The Franchise shall remain in effect, pursuant to the terms and conditions <br /> contained therein, until October 11, 2014, or until a new agreement is entered into between the <br /> parties, or until the Franchise is terminated pursuant to its terms, whichever shall first occur. <br /> Ordinance No. 1659, Series 2014 <br /> Page 1 of 3 <br />
