<br />ORDINANCE NO. 1060 <br />SERIES 1991 <br /> <br />AN ORDINANCE TRANSFERRING BY QUIT ClAIM DEED ANY TI1LE <br />AND INIEREST OF THE CTIY OF WUISVILLE IN AN EASEMENT <br /> <br />WHEREAS, Stuart J. Hardman and Grayson K. Hardman, and Thomas E. Johnson <br />and Victoria J. Simpson, current owners of certain property through which the City has an <br />easement, have requested that a certain easement for pedestrian access purposes be <br />transferred by quit claim deed to them; and <br /> <br />WHEREAS, the City Council has determined that such easement is not needed for <br />any public use; and <br /> <br />WHEREAS, such easement is not being used or held for park purposes or for any <br />other governmental purpose; and <br /> <br />WHEREAS, the easement is located within the corporate limits of the City of <br />Louisville; and <br /> <br />NOW, THEREFORE, BE IT ORDAINED BY THE CTIY COUNCIL OF THE <br />CTIY OF WUISVILLE, COLORADO: <br /> <br />Section 1. Any title and interest of the City of Louisville in the easement described <br />in Exhibit "A" attached hereto and incorporated herein by this reference shall be <br />transferred by quit claim deeds to Stuart J. Hardman and Grayson K. Hardman, and <br />Thomas E. Johnson and Victoria J. Simpson, current owners of the affected property as <br />follows: that half of the easement located on Lot 25, Block 1, Enclave Replat, City of <br />Louisville, County of Boulder, State of Colorado, shall be transferred to Thomas E. <br />Johnson and Victoria J. Simpson, current owners of said Lot 25; that half of the easement <br />located on Lot 26, Block 1, The Enclave Replat, City of Louisville, County of Boulder, <br />State of Colorado shall be transferred to Stuart J. Hardman and Grayson K. Hardman, <br />current owners of said Lot 26. <br /> <br />Section 2. The Mayor of the City of Louisville is authorized to execute on behalf <br />of the City the quit claim deeds described in Section 1. <br /> <br />Section 3. This ordinance is necessary for the immediate preselVation of the public <br />health and safety in order to permit the timely transfer of the property within which the <br />easements being transferred herein are located and this ordinance shall take effect upon <br />adoption and signing by the Mayor if approved by three-fourths of the members of City <br />Council. <br /> <br />DEJ~ lED <br /> <br />12/3{q{ <br />
