Bronstein, current owner of certain <br />property through which the City has certain easements and <br />rights-of-way, has requested that a certain easement and right of <br />way for road purposes and an easement for outflow line of a sewer <br />plant together with an easement for road purposes be transferred <br />by quit claim deed to him; and <br /> <br />WHEREAS, the City Council has determined that such easements <br />and rights of way are not needed for any public use; and <br /> <br />WHEREAS, such easements and rights of way are not being used <br />or held for park purposes or for any other governmental purpose; <br />and <br /> <br />WHEREAS, the easements and rights of way are not located <br />within the corporate limits of the city of Louisville; and <br /> <br />I <br />I <br /> <br />WHEREAS, the sum of $20,000.00 plus interest is being held in <br />an account at the First Federal Bank in Louisville, Colorado <br />(Account No. 10-134027-1) on behalf of the City of Louisville; and <br /> <br />WHEREAS, the condition of the release of the sum total of the <br />account is that the City release one of the easements described <br />herein. <br /> <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br /> <br />section 1. Any title and interest of the City of <br />Louisville in easements and rights of way described in Exhibit "A" <br />attached hereto and incorporated herein by this reference shall be <br />transferred by quit claim deed to Arthur L. Bronstein, current <br />owner of the affected property. <br /> <br />section 2. The Mayor of the City of Louisville is <br />authorized to execute on behalf of the city the quit claim deed <br />described in section 1. <br /> <br />section 3. This ordinance is necessary for the immediate <br />preservation of the pUblic health and safety in order to permit the <br />timely transfer of the property within which the easements being <br />transferred herein are located and this ordinance shall take effect <br /> <br />1 <br />
