<br />3-2- <br /> <br />WHEREAS, Louisville and Broomfield, with the City of Lafayette <br />and Boulder County, Colorado, entered into an Intergovernmental <br />Agreement, Northwest Parkway (Boulder County Area) Comprehensive <br />Development Plan (" Intergovernmental Agreement" ) effective on April <br />29, 1991, paragraph 6 of which states that the City agrees to <br />support the creation of a special improvement district for the <br />purpose of constructing, or otherwise acquiring, an interchange at <br />96th Street and U.S. Highway 36, in Boulder County, provided that <br />the proposed District includes only property all owners of which <br />have petitioned Broomfield for the formation of or inclusion into <br />such District and provided that all owners of such property which <br />is located within Louisville have notified the City Council of the <br />city of their desire to be included within such District; and <br /> <br />WHEREAS, the District to be formed by Broomfield includes only <br />property all owners of which have petitioned Broomfield for the <br />formation of the District; and <br /> <br />WHEREAS, all owners of property located within the City and <br />proposed to be located within the District have notified the City <br />Council of the City of their desire to be included within the <br />District. <br /> <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br /> <br />Section 1. Based on the foregoinq findings, the Ci.ty <br />Council. of the City of Louisville, Colorado (the "Council") hereby <br />consents to the creation of the District by Broomfield, which <br />District shall be formed for the purpose of generally constructing <br />and acquiring street improvements to the interchange at 96th Street <br />and U. S . Highway 36 and the extension of 96th Street from the <br />interchange to Coal ton Road on the south end to Carbon Road on the <br />north, as described in Exhibit B attached hereto and incorporated <br />herein by this reference, and consents to the inclusion within the <br />District of the Property located within the City and described in <br />Exhibit A, attached hereto and incorporated herein by this <br />reference. No other property located within the City shall be <br />included within the District except by enactment of a separate <br />ordinance by the City Council. <br /> <br />Section 2. The City <br />construction and acquisition <br />constitute the Project, which <br />described in Exhibit B. <br /> <br />Council hereby approves the <br />of the street improvements which <br />improvements are more particularly <br /> <br />Section 3. This ordinance, upon its final passage and <br />adoption, shall be filed in the records kept by the City Clerk for <br />that purpose and shall be authenticated by the signatures of the <br />Mayor and the City Clerk. <br /> <br />2 <br />
