PENDING LITIGATION (Louisville Charter, Section 5 -2(d) — Authorized Topics — .Consultation with an attorney representing the City with respect to pending litigation and C.R.S. 24 -6- 402 (4)(b)) The City Manager and City Attorney requested the City Council convene an Executive Session for the purpose of consultation with respect to pending litigation. REGULAR BUSINESS ITEMS SUSPENDED City Attorney Light introduced the requests for executive session. The City Manager has requested the City Council convene an executive session for the purpose of consultation with an attorney representing the City with respect to consideration of potential real property acquisitions and dispositions. The City Manager requested a second executive session, and the City Attorney Light joined in the request, for the purpose on consultation with attorneys with respect to pending litigation. City Clerk Varra read Section 2.90.050 — Public statement of the Louisville Municipal Code, which outlines the topics permitted for discussion in an executive session. City Attorney Light stated the authority to conduct an executive session: (Louisville Charter, Section 5 -2(c) — Authorized Topics — Consideration of real property acquisitions and dispositions, but only as to appraisals and other value estimates and strategy, and C.R.S. 24- 6- 402(4)(a)) and Louisville Charter, Section 5 -2(d) — Authorized Topics — Consultation with an attorney representing the City with respect to pending litigation and C.R.S. 24- 6- 402(4)(b)). He stated the City Manager was requesting an executive session regarding the first authorized topic. MOTION: Mayor Muckle moved the City Council adjourn to executive session for the purpose of consideration real property acquisitions and dispositions, but only as to appraisals and other value estimates and strategy and the executive session include the City Council, City Manager, City Attorney, Economic Development Director, Planning Director, Deputy City Manager and attorneys Malcolm Murray and Joe Rivera. Council member Keany seconded the motion. The motion carried by a vote of 6 -0. City Attorney Light stated the City Manager is requesting an executive session regarding consultation regarding pending litigation. He stated that pending litigation includes situations where a lawsuithas been filed and situations where the person requesting the session believes in good faith that a lawsuit may result. He stated he joins in the request and believes the situation proposed for discussion is of such a nature that legal action may result.
