City Council <br />Meeting Minutes <br />April 15, 2014 <br />Page 7 of 15 <br />and fiber in City conduit in exchange for Zayo installing additional City conduit and fiber <br />on Dillon Road between S. 88th and S. 104th Streets. The City Attorney has reviewed <br />and approved the agreement. <br />The main part of the agreement is the exchange for allowing Zayo Group to over -pull <br />micro - conduit within existing City conduit. The City would realize an estimated savings <br />of approximately $200,000, the cost estimated for the City's contractor to install fiber <br />and conduit from 88th Street to South 104th Street on Dillon Road. Staff estimates the <br />one -time value of the license and exchange to be approximately $190,000. <br />COUNCIL QUESTIONS <br />Council member Keany inquired whether this co- mingling of lines would limit the City's <br />ability for future expansion. IT Director Neves explained one of the risks would be the <br />City could reach capacity of conduit, but currently 50% of the fiber is dark fiber (not lit <br />up). He felt there was plenty of capacity for future growth. <br />Council member Keany asked if IT Manager Neves foresees an issue with limited <br />capacity in the future. IT Manager Neves estimated the City has fiber capacity for the <br />next ten years. At that point, it could be in the City's best interest to consider another <br />public /private partnership. <br />Council member Lipton asked what the City's rights are under the agreement if Zayo <br />changes ownership and is there a potential exit strategy. IT Manager Neves explained <br />the City has the right to ask for an improvement at any time. The City could also ask <br />Zayo to abandon the conduit and the City could take it over as City property. The City <br />could actually request Zayo remove everything out of the conduit. <br />Council member Keany felt this was a very good use of a public /private partnership and <br />benefits the City and the business community in Louisville. <br />MOTION: Council member Keany moved to approve Resolution No. 22, Series 2014, <br />seconded by Council member Stolzmann. Roll call vote was taken. The motion carried <br />by a vote of 6 -0. <br />RESOLUTION No. 23, SERIES 2014 — A RESOLUTION ESTABLISHING THE <br />LOUISVILLE / SUPERIOR JOINT ISSUE COMMITTEE <br />Mayor Muckle requested a staff presentation. <br />City Manager Fleming reviewed Resolution No. 23, Series 2014, which establishes a <br />Louisville /Superior Joint Issues Committee to address issues of mutual interest between <br />the communities. Previously, the Louisville /Superior IGA referenced an Interchange <br />Committee consisting of two Louisville Council members, two Superior Trustees and <br />staff to provide recommendations and coordination on the US 36 McCaslin Interchange. <br />
