<br />Howard stated that from BNRR reports, train accidents on main line tracks were some of the lowest <br />in the United States in Colorado. He stated that, if the LHA was in compliance with the six <br />conditions on the resolution, he did not see any reason to deny this resolution. <br /> <br />Sisk thanked the LHA for their redesign. <br /> <br />Mayer stated that the current design created a situation where there was no measurable risk, with the <br />setback being a minimum of 75'. He pointed out that it was a straight track and the trains coming <br />through Louisville do not go more than 30 m.p.h. <br /> <br />Davidson called for any other Council comments. <br /> <br />NONE <br /> <br />Sisk moved that Council approve Resolution No. 31, Series 1996, with the six conditions and adding <br />to condition NO.4 that the screening of the patio area would be left to a mutual agreement between <br />the Housing Authority and Planning Director Paul Wood's office. Seconded by Mayer. Roll call was <br />taken. Motion passed by a 5 - 1 vote with Lathrop voting against and Keany being absent. <br /> <br />ORDINANCE NO. 1216, SERIES 1996 - AUTHORIZING THE RELEASE OF ANY <br />INTEREST OF THE CITY OF LOUISVILLE IN AN EASEMENT LOCATED IN THE <br />COAL CREEK RANCH, FINING NO.1 - 1ST READING - SET PUBLIC HEARING 5/21/96 <br /> <br />Griffiths read by title only Ordinance No. 1216, Series 1996, "An ordinance authorizing the release <br />of any interest of the City of Louisville in an easement located in Coal Creek Ranch, filing NO.1. " <br /> <br />Paul Wood, Planning Director, stated that the purpose of this ordinance was to eliminate a 200' wide <br />easement on the Coal Creek Ranch filing No. 1 Subdivision Plat, which was approved in 1988, to <br />maintain a 200' setback between the structures and the gas well. The gas well has been removed. <br /> <br />Davidson called for Council comments or questions. <br /> <br />Mayer asked if this would allow the creation of any new lots or did it just remove a restriction. <br /> <br />Wood stated that it removes a restriction over four currently platted lots in Coal Creek Ranch <br />allowing for more flexibility. <br /> <br />Mayer moved that Council approve Ordinance No. 1216, Series 1996, on first reading, place it out <br />for publication, and set the public hearing for May 21, 1996. Seconded by Sisk.
