<br />~0.0R?7~() 01 '10/91 03:50 PM REAL ESTATE RECORDS <br />'1I_t..........f..F 'oJ' / .. <br />F1658 CHARLOTTE HOUSTON BOULDER CNTY CO RECORDER <br /> <br />3-1 <br /> <br />ORDINANCE NO. 1034 <br /> <br />SERIES 1990 <br /> <br />AN ORDINANCE AMENDING SECTION 3.16.020 OF THE LOUISVILLE MUNICIPAL <br />CODE CONCERNING THE CAPITAL IMPROVEMENT FEE AND PROVIDING FOR A <br />CREDIT AGAINST SUCH FEE <br /> <br /> <br />WHEREAS, the City has in effect a capital improvement fee <br />which is applicable to residential construction; and <br /> <br />WHEREAS, the capital improvement fee is imposed to help <br />defray certain costs arising from or attributable to residential <br />construction, as set forth in Section 3.16.060 of the City Code; <br />and <br /> <br />WHEREAS, construction and building materials purchased for <br />the construction of residential dwelling units are subject to the <br />City sales tax, but not to the City use tax; and <br /> <br />WHEREAS, when the city use tax was adopted, construction and <br />building materials used in such residential construction were <br />specifically exempted from the use tax because the capital <br />improvement fee was in effect; and <br /> <br />WHEREAS, as a result of this use tax exemption, purchases of <br />construction and building materials from suppliers outside the City <br />are subject neither to the City sales tax nor to the City use tax, <br />but purchases of construction and building materials from suppliers <br />inside the City are subject to City sales tax, resulting in a <br />disadvantage to suppliers inside the city; and <br /> <br />WHEREAS, the city recognizes this disadvantage and wishes to <br />address this disadvantage on an interim basis in the manner set <br />forth herein, until such time as a more comprehensive manner of <br />addressing this disadvantage can be achieved; <br /> <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br /> <br />section 1. Section 3.16.020 of the Louisville Municipal Code <br />is repealed and reenacted to read as folJOv.Ts: <br /> <br />3.16.020 Fee designated. <br /> <br />A. Any contractor applying for a building permit for <br />a residential dwelling unit in accordance with Chapter <br />15.04 shall, as a condition of obtaining such building <br />perm.it, pay to the city a capital improvement fee, as <br /> <br />1 <br />
