<br />:!'--'\i 03~5856 04/05/90 02:'~ i PM REAL ESTATE R[cJ-:IRDS <br />.>21 CHAF;:LDTTE HDUST( BOULDEr.;; CNTY CD F;:EC DER <br /> <br />?-/\ <br /> <br />ORDINANCE NO. 1025 <br />AN ORDINANCE AMENDING SECTION 5.08,050(H) OF <br />THE LOUISVILLE MUNICIPAL CODE DELETING <br />FERMENTED MALT LIQUOR LICENSE FEE AND ADDING <br />AN OPTIONAL PREMISES LICENSE FEE; AND DEClARING AN EMERGENCY <br /> <br />WHEREAS, 12-47-139 C.R.S., 1973, as amended no longer <br />allows for payment of an annual fee for a Fermented Malt Liquor <br />License to a municipality as provided by Section 5.08,050(H) of <br />the Louisville Municipal Code;: and <br /> <br />WHEREAS, the same st:atute does allow for payment of an <br />annual fee for an Optional Premises License, which is not <br />provided for by Section 5,08.050 of the Louisville Municipal ! <br />Code; and ! <br /> <br />WHEREAS, it is the desire of the City Council to have <br />the Municipal Code in compliance with state law; <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF <br />LOUISVILLE, COLORADO THAT SECTION 5.08.050(H) OF THE LOUISVILLE <br />MUNICIPAL CODE SHALL BE AMENDED AS FOLLOWS: <br /> <br />Section I <br />The present language of subsection H shall be repealed <br />in its entirety, <br /> <br />follows: <br /> <br />Section 2 <br />A new subsection H shall be added which shall read as <br /> <br />H. For each option premises license, Three <br />Hundred Twenty-Five Dollars. <br /> <br />Section 3 <br />If any part, section, subsection, sentence, clause or <br />phrase of this ordinance is for any reason held to be invalid, <br />such decision shall not effect the validity of the remaining <br />portions of this ordinance; and the City Council hereby declares <br />it would have passed this ordinance, and each part, section, <br />subsection, sentence, clause or phrase thereof, regardless of the <br />fact that ny one or more parts, sections, subsection, clauses or <br />phrases be declared invalid. <br /> <br />Section 4 <br />The City Council hereby finds, determines and declares <br />that this ordinance is necessary and proper for the health, <br />safety and welfare of the City of Louisville and the inhabitants <br />thereof, The City Council has determined that in order to have <br />municipal recreational facilities licensed prior to their opening <br />dates it is necessary for the preservation of the public <br />property, health and welfare, peace and safety, that this matter <br />be approached as an emergency ordinance. <br /> <br />1 <br />
