<br />'1i 0:358~>5 04/05/90 0Tti PM REAL ESTATE r.-"'~ORDS <br />. 1621 CHARLOTTE HOUS._~ BOULDER CNTY CO RL JRDER <br /> <br />ORDINANCE NO. 1024 <br />AN ORDINANCE AMENDING SECTION 5.08.030(H) OF <br />THE LOUISVILLE MUNICIPAL CODE DELETING A <br />"FERMENTED MALT LIQUOR LICENSE" AND ALLOWING <br />FOR ISSUANCE OF AN "OPTIONAL PREMISES <br />LICENSE "; AND DECLARING AN EMERGENCY <br /> <br />;y\ <br /> <br />WHEREAS, 12-47-135 C.R.S., 1973, as amended no longer <br />allows for the issuance of a Fermented Malt Liquor License by a <br />local licensing authority, and as currently allowed by section <br />5.08.030 (14) of the Louisvillle Municipal Code; and <br /> <br />WHEREAS, the same statute does allow for the issuance <br />of an Optional Premises License, which is not provided for by <br />Section 5.080,030 of the Louisville Municipal Code; and <br /> <br />WHEREAS, the City Council of the City of Louisville <br />sits as the Local Liquor Licensing Authority for the City of <br />Louisville, and derives its power and authority from state <br />statutes and local ordinances;~ and <br /> <br />I <br /> <br />WHEREAS, it is the desire of the City Council to have <br />the Municipal Code in compliance and conformity with state law; <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF <br />LOUISVILLE, COLORADO THAT SECTION 5.08.030(H) OF THE LOUISVILLE <br />MUNICIPAL CODE SHALL BE AMENDED AS FOLLOWS: <br /> <br />Section I <br />The present language of subsection H of section <br />5.08.030, including parts 1, 2 and 3 shall be repealed in its <br />entirety. <br /> <br />follows: <br /> <br />Section 2 <br />A new subsection H shall be added which shall read as <br /> <br />H. OPTIONAL PREMISE LICENSE. <br />An optional premise license shall be granted <br />for optional premises approved by the local licensing <br />authority to persons selling malt, vinous, and <br />spirituous liquors by the drink only to customers for <br />consumption on the optional premises and for storing <br />malt, vinous, and spirituous liquors in a secure area <br />on or off the optional premises for future use on the <br />optional premises, <br /> <br />Section 3 <br />If any part, section, subsection, sentence, clause or <br />phrase of this ordinance is for any reason held to be invalid, <br />such decision shall not effect the validity of the remaining <br />portions of this ordinance; and the City Council hereby declares <br />it would have passed this ordinance, and each part, section, <br /> <br />1 <br />
