City Council <br />Meeting Minutes <br />May 6, 2014 <br />Page 4 of 27 <br />Mayor Pro Tem Dalton reminded Comcast customers the City cannot negotiate the <br />content of cable package offerings, nor under the current findings of "effective <br />competition" can the City negotiate the pricing of those offerings under existing Federal <br />Law. The Council will discuss the "effective competition" issue at a future Council <br />meeting. The City can negotiate the fees charged to Comcast for the use of the City's <br />right of way, but Comcast is allowed to and typically does pass those on to the <br />customers,'and are displayed on the monthly bills from Comcast. Although Comcast <br />provides Broadband internet access, under the Federal regulations that govern these <br />franchise agreements, broadband service is not eligible for negotiation under the <br />franchise agreement. Mayor Pro Tem Dalton will continue to provide updates on the <br />negotiations in this forum. <br />COUNCIL COMMENTS <br />Mayor Muckle asked Mayor Pro Tem Dalton to explain the "less dense" concept. Mayor <br />Pro Tem Dalton explained this term refers to individuals who are charged extra to run <br />cable to their homes due to being a significant distance from other residents and /or <br />businesses. The proposal specifies Comcast should have a customer "less dense" per <br />mile charge to take in the outlining area homes. <br />Council member Lipton inquired about Century Link. Mayor Pro Tem Dalton explained <br />Century Link is a different provider and is not covered under the franchise agreement. <br />RESOLUTION No. 26, SERIES 2014 — A RESOLUTION <br />AMENDING THE 2014 BUDGET BY AMENDING APPROPRIATONS IN THE <br />GENERAL FUND, OPEN SPACE & PARKS FUND, CONSERVATON TRUST - <br />LOTTERY FUND, CEMETERY FUND, HISTORIC PRESERVATION FUND, CAPITAL <br />PROJECTS FUND, WATER UTILITY FUND, WASTEWATER UTILITY FUND, STORM <br />WATER UTILITY FUND, GOLF COURSE FUND, BUILDING MAINTENANCE FUND, <br />TECHNOLOGY MANAGEMENT FUND, AND FLEET MANAGEMENT FUND FOR <br />CARRY FORWARD OF APROPRIATIONS AND ADDITIONAL EXPENDITURES <br />WITHIN SUCH FUNDS AND ADJUSTING BUDGETED REVENUE IN THE GENERAL <br />FUND, OPEN SPACE & PARKS FUND, HISTORIC PRESERVATION FUND, <br />CAPITAL PROJECTS FUND, WATER UTILITY FUND, WASTEWATER UTILITY <br />FUND, STORM WATER UTILITY FUND, GOLF COURSE FUND, AND SOLID WASTE <br />& RECYCLING FUND — Public Hearing <br />Mayor Muckle requested a staff presentation. <br />Finance Director Watson reviewed Resolution No. 26, 2014 proposes a series of <br />amendments to the City of Louisville's 2014 Operating & Capital Budget. Staff <br />requested the proposed amendments to: <br />1. Carry- forward unused appropriations from 2013 to 2014 for projects Council <br />approved for 2013 but, for various reasons, staff needed to extend work on the project <br />
