CITY OF LOUISVILLE <br />RESOLUTION N0. 13, SERIES 1975 <br />RESOLUTION OF THE GOVERNING BODY OF THE CITY OF LOUISVILLE, <br />COLORADO ASSUMING RESPONSIBILITY FOR CARRYING OUT ALL THE PROVI- <br />SIONS OF THE NATIONAL ENVIRONMENTAL POLICY ACT OF 1969. <br />WHEREAS, the City of Louisville, Colorado is entitled to funds <br />under the Housing and Community Development Act of 1974; and <br />WHEREAS, regulations relating to said act require that the <br />City of Louisville, Colorado assume responsibility for carrying <br />out all the provisions of the National Environmental Policy Act <br />of 1969 relating to particular projects for which the release of <br />funds is sought. <br />NOW, THEREFORE, be it resolved by the governing body of the <br />City of Louisville, Colorado: <br />1. That the Mayor of the City of Louisville is authorized <br />to and shall carry out the responsibilities of the <br />Responsible Federal Official" as that term is used in <br />the National Environmental Policy Act of 1969 and <br />applicable regulations thereunder with the understanding <br />that such responsibilities include, where applicable, <br />the conduct of environmental reviews, decision-making <br />and action as to environmental issues; preparation and <br />circulation of draft and final environmental impact <br />statements, if appropriate; and assumption of lead <br />agency responsibilities for preparation of such state- <br />ments in behalf of federal agencies other than HUD when <br />such agencies consent to such assumption, if appropriate. <br />2. The Mayor of the City of Louisville shall be subject to <br />the jurisdiction of the Federal courts pursuant to section <br />104(1) of the Housing and Community Development Act of <br />1974, acting solely in his capacity as Mayor, with the <br />understanding that such Mayor shall not be represented <br />by the Department of Justice in court, but reasonable <br />defense costs, including the fees of attorneys and <br />experts, incurrE~d in environmental litigation may <br />be funded from i~he City's grant amount. <br />PASSED AND APPROVED this 6th day of May, 1975. <br />.~ f <br />i %` <br />~ Mayor <br />~ -/ <br />City Clerk <br />
