CITY OF LOUISVILLE RESOLUTION N0. 13, SERIES 1975 RESOLUTION OF THE GOVERNING BODY OF THE CITY OF LOUISVILLE, COLORADO ASSUMING RESPONSIBILITY FOR CARRYING OUT ALL THE PROVI- SIONS OF THE NATIONAL ENVIRONMENTAL POLICY ACT OF 1969. WHEREAS, the City of Louisville, Colorado is entitled to funds under the Housing and Community Development Act of 1974; and WHEREAS, regulations relating to said act require that the City of Louisville, Colorado assume responsibility for carrying out all the provisions of the National Environmental Policy Act of 1969 relating to particular projects for which the release of funds is sought. NOW, THEREFORE, be it resolved by the governing body of the City of Louisville, Colorado: 1. That the Mayor of the City of Louisville is authorized to and shall carry out the responsibilities of the Responsible Federal Official" as that term is used in the National Environmental Policy Act of 1969 and applicable regulations thereunder with the understanding that such responsibilities include, where applicable, the conduct of environmental reviews, decision-making and action as to environmental issues; preparation and circulation of draft and final environmental impact statements, if appropriate; and assumption of lead agency responsibilities for preparation of such state- ments in behalf of federal agencies other than HUD when such agencies consent to such assumption, if appropriate. 2. The Mayor of the City of Louisville shall be subject to the jurisdiction of the Federal courts pursuant to section 104(1) of the Housing and Community Development Act of 1974, acting solely in his capacity as Mayor, with the understanding that such Mayor shall not be represented by the Department of Justice in court, but reasonable defense costs, including the fees of attorneys and experts, incurrE~d in environmental litigation may be funded from i~he City's grant amount.
