Sec. 3.30.010. Imposed <br /> Thereft is hereby imposed, pursuant to C.R.S § 29-11-101 et seq., as <br /> amended, (the Act) upon all telephone exchange access facilities within the city <br /> an emergency telephone charge in an amount not to exceed$0.75 per month per <br /> exchange access facility, per wireless communications access, and per <br /> interconnected voice-over-internet-protocol service in those portions of the City <br /> for which emergency telephone service will be provided, the proceeds from which <br /> shall be collected and administered according to the terms of the <br /> Intergovernmental Agreement concerning the implementation of a "E911" <br /> Emergency Telephone Service between the County of Boulder, the city of <br /> Boulder, et al. dated September 22, 1987, as amended, and the Act, as amended. <br /> The city council further authorizes the authority board as described in the <br /> intergovernmental agreement to set such lesser charges as the authority board may <br /> from time to time determine are appropriate in the course of the authority board's <br /> exercise of its functions under the intergovernmental agreement. <br /> Sec. 3.30.020. Collection. <br /> Telephone sService suppliers providing exchange telephone service& <br /> telecommunications service via wireless carrier, and interconnected voice-over- <br /> internet-protocol service shall in the city are authorized to collect the emergency <br /> telephone charge imposed by this chapter in accordance with C.R.S. § 29-11-101 <br /> et seq, as amended. <br /> Section 2. If any portion of this ordinance is held to be invalid for any reason, such <br /> decision shall not affect the validity of the remaining portions of this ordinance. The City <br /> Council hereby declares that it would have passed this ordinance and each part hereof <br /> irrespective of the fact that any one part be declared invalid. <br /> Section 3. The repeal or modification of any provision of the Municipal Code of the <br /> City of Louisville by this ordinance shall not release, extinguish, alter, modify, or change in whole <br /> or in part any penalty, forfeiture, or liability, either civil or criminal, which shall have been incurred <br /> under such provision, and each provision shall be treated and held as still remaining in force for the <br /> purpose of sustaining any and all proper actions, suits, proceedings, and prosecutions for the <br /> enforcement of the penalty, forfeiture, or liability, as well as for the purpose of sustaining any <br /> judgment, decree, or order which can or may be rendered, entered, or made in such actions, suits, <br /> proceedings, or prosecutions. <br /> Section 4. All other ordinances or portions thereof inconsistent or conflicting with <br /> this ordinance or any portion hereof are hereby repealed to the extent of such inconsistency or <br /> conflict. <br /> Ordinance No. 1662, Series 2014 <br /> Page 2 of 3 <br />
