CITY OF LOUISVILLE <br />RESOLUTION NO. Z, SERIES 1976 <br />RESOLUTION OF THE GOVERNING BODY OF THE CITY OF LOUISVILLE, COLORADO ASSUMING <br />RESPONSIBILITY FOR CARRYING OUT ALL THE PROVISIONS OF THE NATIONAL ENVIRONMENTAL <br />POLICY ACT OF 1969. <br />WHEREAS, the City of Louisville, Colorado is entitled to funds under the Housing <br />and Community Development Act of 1974; and <br />WHEREAS, regulations relating; to said act require that the City of Louisville, <br />Colorado assume responsibility for carrying out all the provisions of the <br />National Environmental Policy Act of 1969 relating to particular projects for <br />which the release of funds is sought. <br />NOW, THEREFORE, be it resolved by the governing body of the City of Louisville, <br />Colorado: <br />1. That the Mayor of the City of Louisville is authorized to and shall carry <br />out the responsibilities of the "Responsible Federal Official" as that term <br />is used in the National Environmental Policy Act of 1969 and applicable <br />regulations thereunder with the understanding that such responsibilities <br />include, where applicable, the conduct of environmental reviews, decision- <br />making and action as to environmental issues; preparation and circulation <br />of draft and final envire~nmental impact statements, if appropriate; and <br />assumption of lead agency responsibilities for preparation of such state- <br />ments in behalf of federal agencies other than HUD when such agencies <br />consent to such assumption, if appropriate. <br />2. The Mayor of the City of Louisville shall be subject to the jurisdiction of <br />the Federal courts pursuant to section 104(1) of the Housing and Community <br />Development Act of 1974, acting solely in his capacity as Mayor, with the <br />understanding that such N[ayor shall not be represented by the Department of <br />Justice in court, but reasonable defense costs, including the fees of <br />attorneys and experts, incurred in environmental litigation may be funded <br />from the City's grant amount. <br />PASSED AND APPROVED THIS 4th day of May, 1976. <br />~~ <br />City Clerk <br />Mayor <br />
