ORDINANCE NO. 1660 SERIES 2014 AN ORDINANCE AUTHORIZING THE PAYMENT OF CITY MONEYS FOR THE ACQUISITION OF REAL ESTATE FOR PARKS AND OPEN SPACE PURPOSES WHEREAS, the City of Louisville intends to enter into a Purchase Contract to Buy and Sell Real Estate with the First Baptist Church of Louisville (the "Purchase Contract"), for the acquisition of approximately 5.13 acres of property owned by the First Baptist Church of Louisville; and WHEREAS, the property Y lies in the NW I/4 of Section 8, Township 1 South, Range 69 West of the 6th P.M., and is more particularly described in Exhibit A, attached hereto and incorporated herein(the"Property"); and WHEREAS, Louisville shall pay the owner a total purchase price of one million two hundred fifty thousand dollars($1,250,000.00) for the Property; and WHEREAS, the City intends to acquire the Property for parks and open space purposes; and WHEREAS,the City Council by this ordinance desires to identify the source of funding for such purchase, and otherwise comply with applicable laws regarding the acquisition of the Property. NOW,THEREFORE,BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LOUISVILLE,COLORADO: Section 1. Unless other funds become available for use by the City as determined by the City Council, moneys from the City Conservation Trust Fund—Land Acquisition shall be used to pay at closing the purchase price of one million two hundred fifty thousand dollars ($1,250,000.00) for the Property; which Property is further described on Exhibit A attached hereto and in the Purchase Contract therefor. Section 2. City payment for the Property shall be made in cash, certified funds or City warrant, subject to the Purchase Contract and to any necessary budgetary transfers or supplementary budgets and appropriations in accordance with State law. Such City payment is subject to and conditioned upon satisfaction of all conditions in the Purchase Contract for the Property. Section 3. Nothing in this Ordinance is intended to nor should be construed to create any multiple-fiscal year direct or indirect City debt or fiscal obligation whatsoever. Section 4. If any portion of this ordinance is held to be invalid for any reason, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council hereby declares that it would have passed this ordinance and each part hereof irrespective of the fact that any one part be declared invalid.
