WHEREAS, said public hearing was held on May 4, 1976 and which <br />hearing was continued to and closed on June 1, 1976, and <br />WHEREAS, the Louisville, Colorado master plan and utility plans <br />do not project the need for nor the construction of any new domestic <br />water or sewage treatment systems, and <br />WHEREAS, the City staff and consultants have recommended to the <br />City Council that the City incorporate the requirements and evaluation <br />criteria contained in the Land Use Commission "Mode Regulations", <br />Chapter 15, Major Extensions of Existing Domestic Water and Sewage <br />Treatment Systems into existing City land use and development control <br />ordinances, resolution:> and regulations to achieve a more timely <br />and continuing review and evaluation than permitted under H.B. 1041 <br />(9174) to avoid unnece<.~sary and counter-productive duplication of <br />controls, and <br />WHEREAS, § 2-1-104 of the Colorado Land Use Commission "Guidelines <br />for :identification ancf Designation", adopted September 19, 1975 provide <br />for achieving the intent of H.B. 1041 (1974) through land use control <br />procedures authorized t-y statute other than H.B. 1041 (1974), and <br />WHEREAS, the City staff and consultants have met and worked with <br />the Land Use Commission staff to assure that the intent of H.B. 1041 <br />(1974) would be achieved through proper amendment of existing land use <br />and development control ordinances, resolutions and regulations, and <br />WHEREAS, the Land Use Commission staff has testified that, in the <br />staff's judgment and opinion, the intent of H.B. 1041 can be achieved <br />through amendment of existing City land use and development control <br />ordinances, resolutions and regulations if the City of Louisville <br />adopts the proposed amendments submitted to the Lead Use Commission <br />staff on May 28, 1976 and if the City adopts other such resolutions <br />and agreements recommended by the Land Use Commission staff. <br />-2- <br />
