City Council <br />Meeting Minutes <br />May 20, 2014 <br />Page 19 of 20 <br />cost the homeowner $14,000 in exchange for the vacation of the 10.5 ft. strip of right of <br />way. <br />Council member Stolzmann asked if fire lane width was maintained. The answer was <br />yes. She asked if this would prevent putting a sidewalk on the other side. The answer <br />was no. <br />Mayor Muckle noted the alignment with the trail was on the other side of the street and <br />wondered if placement of a sidewalk on the other side by the City wouldn't be a better <br />idea. <br />Planning and Building Safety Director Russ stated staff saw this as an opportunity to get <br />the right of way completed and get the trail connection at no cost to the City. <br />Mayor Muckle wondered if the expectation was that the additional land be used to get <br />additional FAR (floor area ratio). <br />Planning and Building Safety Director Russ said that is the terms of this agreement. If <br />Council doesn't feel this is a reasonable part of this agreement they could use their <br />discretion to change it. <br />Andy Messick, 879 Cleveland Court, Louisville, CO owns the property on Lincoln as a <br />rental, as it has been for years. He simply wanted to see some improvements on that <br />side of the street and didn't have plans to demolish and re -build at this time. He would, <br />however, have to reconsider the agreement if the floor area ratio piece were not <br />included. <br />Mayor Muckle wondered if staff had a sense of the value of the square footage. <br />Planning and Building Safety Director Russ reported they recently looked at the value of <br />the land but didn't have the math immediately available. <br />Mayor Muckle asked the homeowner if he was aware of the advantages available with <br />historic preservation. Mr. Messick responded he was. <br />Council member Lipton didn't feel the status quo of the street was very good. Mr. <br />Messick added if the street area were cleaned up it would hopefully not allow for parking <br />of construction vehicles in the street for long periods of time. <br />Planning and Building Safety Director Russ believed the land value was near $30,000. <br />In this case the value of the land exceeded the value of the improvement; however, staff <br />did not see any use for the public land. <br />MOTIONS: Mayor Muckle moved to approve the agreement on the ROW vacation on <br />1001 Lincoln Avenue. Council member Keany seconded. All in favor. <br />
