CITY OF LOUISVILLE, COLORADO <br />RESOLUTION N0.19, Series 1974 <br />ANNEXATION POLICY AND GUIDELINE STATEMENT <br />WHEREAS: The city of Louisville desires to encourage the <br />economic development of the adjacent region by <br />encouraging the use and expansion of its utilities <br />and services, and <br />WHEREAS: It is necessary to establish a policy in writing for <br />the purpose of providing guidance to City Administrator, <br />City Council, Planning Commission and any interested <br />parties proposing annexation. <br />THEREFORE, Be it resolved. <br />SECTION I <br />THAT, the credit or financial soundness of the City of Louisville <br />shall not be jeopardized or undly risked for the benefit of <br />proposed areas of development or annexation. <br />THAT, the City of Louisville shall not burden any costs incurred <br />for legal evaluation and engineering feasibility studies to <br />determine the City of Louisville's ability to service entotal any <br />proposed annexation. <br />THAT, the City of Louisville has the right to demand payment of the <br />interested parties proposing annexation, for the City to properly <br />evaluate the following: Water service, sewer service, fire protection, <br />street and alley maintenance service, police protection, environmental <br />impact, flood and drainage, control, legal and engineering services, <br />inclusion to the comprehensive plan and mapping. <br />SECTION II <br />THAT, TO INSURE THE INTERESTED PARTIES PROPOSING ANNEXATION DO NOT <br />WASTE THEIR TIME AND MONIES. THEY ARE TO PROCEED IN THE FOLLOWING <br />MANNER: <br />Step 1.) Contact City Administrator and describe in general <br />the proposed annexation plan, legal, size, <br />residental density, water rights to be included, <br />parks area, etc., pick up copies of all City codes, <br />policies, ordinances and resolutions applicable <br />for annexation and or development. The standard fees <br />for all copies will be charged to the developer at <br />this time. <br />If the City Administrator deems the proposed <br />annexation as potentially feasible, he is to set up <br />a meeting date agreeable with the interested parties <br />proposing annexation on a future Council meeting date. <br />Step 2.) Submission. to Council for consideration of the poten- <br />tial feasibility. If approved, the applicable per <br />acre or portion thereof fee for the First Stage <br />shall be paid at this time, the Second Stage shall <br />be payable as the various land areas are developed. <br />The fee assessed shall be based on the following <br />schedule: <br />STAGE I SIZE OF PROJECT'^ <br />First 40 acres <br />Next 40 acres <br />Balance <br />COST PER ACRE REVIEW FEE <br />Resi entia Industrial* <br />$60 per acre $45 per acre <br />$40 per acre $30 per acre <br />$30 per acre $22 per acre <br />*Indicates 25% reduction from residential <br />
