<br />cooperation with the City of Louisville, Council now was saying that they have no right to enhance <br />themselves by obtaining property compensation, if the property is designated open space. <br /> <br />Davidson closed the public hearing and called for Council comments or questions. <br /> <br />Lathrop wanted each Council member to put themselves in the place of the people that had spoken <br />and think about what it would be like to address their land use issues to three separate entities. He <br />stated that these properties should be acquired on the open market at a fair market value, not in the <br />manner of Resolution No. 37. <br /> <br />Mayer stated that it is the City that provides the value to this land and is trying to provide some <br />rational planning to the process, taking away no one's inherent rights. He commented that he had a <br />clear conscience about Resolution No. 37. <br /> <br />Davidson stated that he insisted on paragraph ten, Defense of Claims/Indemnification. He favored <br />the IGA even though there are some problems. <br /> <br />Lathrop stated that this is a "horrible" agreement with people losing their rights. <br /> <br />Mayer moved that Council approve Resolution No. 37, Series 1996, Intergovernmental Agreement- <br />Lafayette/Louisville Buffer Comprehensive Development Plan. Seconded by Davidson. Roll call was <br />taken. Motion passed by a 4 - 3 vote with Keany, Lathrop, and Levihn voting against. <br /> <br />RESOLUTION NO. 40, SERIES 1996 - ACCEPTING A DEDICATION OF OUTLOT X, <br />BELLA VISTA SOUTH SUBDIVISION <br /> <br />Sisk asked to be excused from discussion of this item due to a conflict of interest. <br /> <br />Davidson excused Sisk. <br /> <br />Paul Wood, Planning Director, stated that this item had been continued to allow staff time to talk to <br />Mr. Hinsberger about the convenience of Outlot X and for the Public Works Department to have an <br />opportunity to gain information on the proposed dedication and how it related to the alignments of <br />the extension of Bella Vista. Outlot X had been conveyed by Mr. Hinsberger by a Quit Claim Deed. <br /> <br />Davidson called for Council questions. <br /> <br />Davidson asked if the proposed routes would make a direct connection to Hwy. 42. <br /> <br />Tom Phare, Public Works Director, did not think the connection would be made due to the railroad <br />crossmg Issue. <br /> <br />4 <br />
