MCCASLIN BLVD, <br />B BUILDING <br /> <br />DATE: JULY 7, 2014 <br /> <br />PRESENTED BY: AARON M. DEJONG <br /> <br /> <br />SUMMARY: <br />The Louisville City Council on May 6, 2014, directed staff to commission a Conditions <br />Consulting, represented by Austin Patten, has been hired to conduct a conditions <br />survey to research if blight conditions exist on the property. <br /> <br />BACKGROUND: <br />since early 2010. Wal-Mart actively marketed the property for over 3 years with <br />brokerage firms CBRE and SRS Realty. They were unsuccessful in finding a new <br />owner for the building for a retail purpose. Centennial Valley Investment, LLC <br />(Centennial Valley) and Seminole Land Holdings, LLC purchased the property in <br />January 2014. Centennial Valley has actively marketed the property but has <br />communicated to the City that private deed restrictions placed on the property, which <br />prohibit retail uses that could compete with other retail uses adjacent to the <br />development, severely limit the potential retail users who would otherwise be interested <br />in using the property. Centennial Valley argues these deed restrictions effectively <br />prevent the property from being occupied again and prevent full utilization of the <br />property for uses allowed by the City zoning. The Louisville City Council on May 6, <br />2014, directed staff to commission a Conditions Survey. <br /> <br />The blight factors identified in the Colorado Revised Statutes are: <br />(a) Slum, deteriorated, or deteriorating structures; <br />(b) Predominance of defective or inadequate street layout; <br />(c) Faulty lot layout in relation to size, adequacy, accessibility, or usefulness; <br />(d) Unsanitary or unsafe conditions; <br />(e) Deterioration of site or other improvements; <br />(f) Unusual topography or inadequate public improvements or utilities; <br />(g) Defective or unusual conditions of title rendering the title nonmarketable; <br />(h) The existence of conditions that endanger life or property by fire or other causes; <br />(i) Buildings that are unsafe or unhealthy for persons to live or work in because of <br />building code violations, dilapidation, deterioration, defective design, physical <br />construction, or faulty or inadequate facilities; <br />(j) Environmental contamination of buildings or property; <br /> <br />
