Planning Commission <br />Meeting Minutes <br />April; 10, 2014 <br />Page 12of 37 <br />In the package is the draft ordinance seen on March 13, 2014 plus then a red line <br />edit, so you will see the highlighted changes to the ordinance. You can <br />recognize what is different now from what was on March 13, 2014. Those <br />changes came based on comments heard from the Planning Commission and <br />the public as well and staff evaluation. <br />The City of Louisville interprets Food Trucks under Use Group #35 in the <br />Municipal Code and defined as Sales and Repair of Motor Vehicles Outdoor <br />Sales Repair, Appiances, Real Goods, Eating and DrinkingEstablishments and <br />Rental Facilities. Within this, we believe any outdoor sales fall into the Eating <br />and Drinking Establishments. Use Group #35 is allowed in the Commercial <br />PCDZ Zone District and is not allowed in Residential, Commercial Neighborhood, <br />Mixed Use Environments as well as PCDZ Residential or Agricultural. It is a <br />special review use in our commonly understood commercial districts of <br />community business and commercial community. <br />Dialogue in the community last year regarding food trucks asked for more clarity, <br />both to the applicant and the community, on what and where food trucks ought to <br />be allowed and not rely on special review use on a case by case basis. <br />At the last meeting, there wereitems that the Planning Commission asked staff <br />to provide new information for today. <br />Can we create a definition for an ice cream vendor as we are giving <br />o <br />exemptions in the code for ice cream vendor. <br />Special consideration for the Centennial Valley and the Art Center and <br />o <br />Memory Square Park. <br />Specific recommendations for performance criteria. <br />o <br />ICE CREAM VENDOR: In the code within the public right of way (ROW), an <br />exemption is given to the ice cream vendor to operate within residential zone <br />districts. We currently allow it through a business license. The definition used <br />for an ice cream vendor is a person or business within a mobile food truck or <br />mobile food vehicle selling or offering for sale pre-packagedice cream or frozen <br />dairy products on the streets or alleys or public places. We use the City of <br />Denver definition but we added the word “pre-packaged.” This is unique to <br />Louisville and in direct response to Commissioner O’Connell’s comments. This <br />is consistent with what theCity has provided with the business license and <br />allowed to operate in that environment. <br />In Section 2 of the Code Definitions, we are recommending a new use groupbe <br />defined as mobile retail food establishments. We are recommending the use be <br />allowed within all the commercial districts as well as the mixed use residual zone <br />district as a use by right. We are saying it is not allowed in residential zone <br />districts. We created a new use in the Use Table of the Zoning Code. <br />In Section 3, we divided this up on performance criteria to operating within the <br />street’s ROW or public parks or public spaces versus private property.
