Planning Commission <br />Meeting Minutes <br />April; 10, 2014 <br />Page 19of 37 <br />Brauneis says given the current situation within the City and the case of the brick <br />and mortar owner, why wouldwewant to limit their success going forward?For that <br />reason alone, I am okay with deleting pre-packaged. <br />Moline wants to know what the rationale is behind the 30 days. <br />Russ says all temporary use with the City of Louisville is limited to 30 days. They <br />can get up to two 30 day periods in a year on any temporary use. We are staying <br />consistent with the temporary use requirements of all the other temporary uses <br />allowed within the City. It is within the public ROW and we don’t want them to <br />operate in perpetuity within a public ROW. If you choose otherwise, we can certainly <br />make it 100%consistent which would allow them two 30 day periods;instead we <br />limited it to one with no more than 5 days. The current uses now are not limited to <br />consecutive day period but Staff felt it appropriate. <br />Brauneis says in his limited experience with mobile food establishments, heis <br />curious if two of these would be allowed to happen. One experience was a <br />fundraiser at an elementary school within Boulder City limits. Nothing was presold. <br />They parked in the school parking lot for sales. Would that be allowed? <br />Russ says the reason was parking on school property. BVSD has rights exclusive of <br />the City. <br />Brauneis saysthe other experience was a non-pre-packagedice cream vending <br />vehicle that came to a block party. <br />Russ says technically that would not be allowed since that it is acommercial retail <br />activity. If they had a contract with the neighborhood or the homeowner, that is room <br />for a catered event. <br />Brauneisasks if a single homeowner agreed to a minimum sale,canit be <br />considered a catered event? <br />Russ says it depends on outside sales. It is a commercial activity. We have one <br />brick and mortar restaurant with an ice cream truck. That doesn’t prevent others <br />from introducing it and creating a competitive ice cream environment which would be <br />great for kids. What Staff is trying to do is balance commercial activity in a residential <br />area. We have appropriate places for that called commercial zone districts. We are <br />trying to balance it out and try to exclude commercial activity in residential areas. <br />Tengler asks when we discussed the economic impact, we settled on the notion that <br />there had been about $800 in taxes collected which is effective a toss-up with <br />perceived lost business with the Downtown businesses. That was deemed to be <br />pretty much neutral impact. <br />Russ says that was for Community Park food events last year. <br />Tengler says he recalls that there had been concern about tax collection. Has there <br />been any breach of that? <br /> <br />
