City Council <br />Meeting Minutes <br />July 15, 2014 <br />Page 17 of 21 <br />allow sampling on site, but felt there was an argument for allowing e- cigarettes sampling <br />in the retail establishments. <br />Council member Keany suggested continuing the ordinance to another meeting. He did <br />not feel the reference to marijuana was necessary, but was supportive of a 15' limit from <br />a business. <br />Mayor Pro Tem Dalton was troubled by the dueling studies and experts and suggested <br />waiting for further studies. He agreed the ordinance should be continued to another <br />meeting. <br />Council member Lipton did not agree Council should wait for more definitive studies. <br />He asked if there was currently any prohibition on the use of e- cigarettes in public or <br />municipal facilities. City Attorney Light confirmed there is no prohibition on e- cigarettes <br />in public or municipal facilities. <br />Council member Lipton had no problem banning e- cigarettes from public or municipal <br />buildings because it sends a message to children. He was troubled about prohibitions <br />from sampling in retail stores. He supported continuing the ordinance. <br />Mayor Muckle favored sampling in retail stores and supported the marijuana smoking <br />ban in public. City Attorney Light explained the ordinance bans smoking in outdoor <br />seating areas. City Attorney Light would point out distinctions in the ordinances. The <br />State Clean Air Indoor Act defines tobacco businesses as a primary business where <br />tobacco products are sold, such as a smoke shop. Smoking in a restaurant, bar or <br />public area is prohibited. He noted the City cannot override the state statute. <br />Council member Loo suggested sampling only be allowed in the primary businesses, <br />but a prohibition in restaurants. <br />Council member Stolzmann supported continuing the ordinance and was comfortable <br />with the 15' distance limit. She felt the reference of marijuana was redundant. She <br />spoke to members of the public who view e- cigarettes as different from smoking. She <br />felt if the City does not want people to smoke e- cigarettes at the library, they should just <br />prohibit it at the library, but not through an ordinance. <br />Mayor Muckle voiced his support for sampling and taking out the e- cigarettes from the <br />ordinance. He supported including marijuana in the ordinance and continuing the <br />ordinance. <br />MOTION: Mayor Muckle moved to continue Ordinance No. 1669, Series 2014 to the <br />September 16 Council meeting, seconded by Council member Loo.
