RESOLUTION NO. 40 <br />SERIES 2014 <br />A RESOLUTION APPROVING AN INTERGOVERNMENTAL AGREEMENT WITH <br />THE COUNTY OF BOULDER CONCERNING MAJESTIC VIEW DRIVE <br />WHEREAS, the City of Louisville ( "the City ") owns right -of -way west of the section <br />line at McCaslin Boulevard in the vicinity of Majestic View Drive (or "the Drive "), and also <br />owns the right -of -way of the Drive adjacent to McCaslin Boulevard, as generally depicted on <br />Exhibit A to the Intergovernmental Agreement accompanying this Resolution; and <br />WHEREAS, the City currently maintains McCaslin Boulevard in the vicinity of Majestic <br />View Drive and has the operational capacity to maintain the Drive; and <br />WHEREAS, Majestic View Drive serves eleven properties in the unincorporated county <br />and the City and the County of Boulder ( "the County ") have a shared desire that the County in <br />2014 undertake a one -time rehabilitation of the Drive and that the County convey to the City <br />right -of -way previously conveyed to the County for the Drive; and <br />WHEREAS, the City and County desire to enter into an Intergovernmental Agreement to <br />set forth their mutual understandings regarding rehabilitation of the Drive, conveyance of right - <br />of -way for the Drive to the City, and related matters; and <br />WHEREAS, the Parties are authorized to enter into this Agreement pursuant to state law, <br />including but not limited to C.R.S. § 29 -1 -201 et seq., and the City Council by this Resolution <br />desires to approve said Intergovernmental Agreement and authorize its execution; <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br />1. The Proposed Intergovernmental Agreement between the City of Louisville and the <br />County of Boulder concerning Majestic View Drive ( "the IGA "), is hereby approved in essentially <br />the same form as the copy of such IGA accompanying this Resolution. <br />2. The Mayor is authorized to execute the IGA on behalf of the City, except that the <br />Mayor is hereby further granted authority to negotiate and approve such revisions to said IGA as the <br />Mayor determines are necessary or desirable for the protection of the City, so long as the essential <br />terms and conditions of the IGA are not altered. <br />3. The Mayor, City Manager, Director of Public Works and City staff are hereby <br />authorized to execute all documents and do all other things necessary on behalf of the City to <br />perform the obligations of the City under the IGA. <br />Resolution No. 40, Series 2014 <br />Page 1 of 2 <br />
