RESOLUTION NO. 43 <br />SERIES 2014 <br />A RESOLUTION APPROVING A FINAL PLANNED UNIT DEVELOPMENT (PUD) PLAN <br />AND SPECIAL REVIEW USE (SRU) TO CONSTRUCT A NEW 8,465 SF DAY CARE <br />FACILITY WITH PARKING AREA AND PLAYGROUNDS ON LOT 6, OF CENTENNIAL <br />VALLEY PARCEL L, FILING 1, SUBDIVISION <br />WHEREAS, there has been submitted to the Louisville City Council an application for a <br />final planned unit development (PUD) and special review use (SRU) to allow for the <br />construction of a new 8,465 SF daycare / pre - school facility with parking area and <br />playgrounds on Lot 6, of the Centennial Valley Parcel L, Filing 1, Subdivision; and <br />WHEREAS, the City Staff has reviewed the information submitted and found it to <br />comply with Louisville Municipal Code (LMC) Chapter 17.28; and <br />WHEREAS, after a duly noticed public hearing on July 10, 2014, where evidence and <br />testimony were entered into the record, including the findings in the Louisville Planning <br />Commission Staff Report dated July 10, 2014, the Planning Commission recommended <br />approval of said Goddard School Final PUD Plan and SRU, located at 380 Centennial <br />Parkway, to the City Council, with one condition: <br />1. The recommendation of approval is subject to the City Attorney's opinion as to the <br />applicability of ordinances governing the location of marijuana facilities within close <br />proximity to schools. <br />WHEREAS, LMC does not prohibit the placement of a day care within close proximity to <br />an existing medical, or retail marijuana facility; and <br />WHEREAS, City Council has reviewed the application, including the recommendation of <br />the Planning Commission, and finds that it complies with Chapter 17.28.210 of the Louisville <br />Municipal Code. <br />NOW THEREFORE, BE IT RESOLVED that the City Council of the City of Louisville, Colorado <br />does hereby approve a final planned unit development (PUD) and special review use (SRU) to <br />construct a new 8,465 SF daycare / pre - school facility with parking area and playgrounds on <br />Lot 6, of the Centennial Valley Parcel L, Filing 1, Subdivision, without condition. <br />PASSED AND ADOPTED this 5th day of August 2014. <br />Nancy Varra, ity Clerk <br />City of Louisville, Colorado <br />By: [/ I AARA-t- <br />Ro ert P.
