111101 MI <br />III <br />IfflI <br />09 26 20 4 03:40 PM <br />Boulder County Clerk, CO <br />ORDINANCE NO. 1664 <br />SERIES 2014 <br />11 <br />W <br />03404772 <br />Page: 1 of 3 <br />DF: $0.00 <br />AN ORDINANCE APPROVING THE VACATION OF A TEN FOOT SIX INCH (10'6 ") <br />BY ONE HUNDRED TWENTY FIVE FOOT (125') PORTION OF SOUTH STREET <br />RIGHT -OF -WAY LOCATED ADJACENT TO LOTS 1, BLOCK 4 IN THE CAPITOL <br />HILL SUBDIVISION IN THE CITY OF LOUISVILLE <br />WHEREAS, by the plat of said Capitol Hill Subdivision, recorded in 1904 Plat Book 2, <br />Page 218, Boulder County Records, there was dedicated for public use and right -of -way 34.2 feet <br />wide and 125 feet in length located south of and adjacent to the Property which, when combined <br />with the adjacent 10 -foot right -of -way dedicated by the plat of the Pleasant Hill Subdivision, <br />recorded July 11, 1894 in Plat Book 1, Page 111, Boulder County Records, provides a right -of -way <br />a total of 44.2 feet wide and 125 feet in length south of and adjacent to the Property (the "Platted <br />Right -of- Way "); and <br />WHEREAS, proper application has been made to the City for vacation of the northernmost <br />ten feet six inches (10'6 ") of said right -of -way, which ten foot six inch (10'6 ") by one hundred <br />twenty five fifty foot (125') area is hereafter referred to as "the Right-of-Way"; and <br />WHEREAS, the City Council finds and determines that the Right -of -Way for which <br />vacation is requested is not and will not be needed for any public purpose; and <br />WHEREAS, the City Council finds and determines that the Right -of -Way for which <br />vacation is requested is not being used or held for park purposes or for any other governmental <br />purpose; and <br />WHEREAS, the City Council has therefore determined that it is appropriate to vacate the <br />City's interests in the easement described herein. <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br />Section 1. The City hereby vacates the northernmost ten foot six inches (10'6 ") of that <br />certain portion of South Street right -of -way located adjacent to Lot 1, Block 4, Capitol Hill <br />Subdivision, which right -of -way was dedicated by the plat of said Capitol Hill Subdivision, <br />recorded in 1904 in Plat Book 2, Page 218, Boulder County Records, and which ten foot six inches <br />by one hundred twenty five foot (10'6" x 125') area of right -of -way vacated by this ordinance is <br />depicted on Exhibit A attached hereto and hereafter referred to as "the Right -of- Way." Title to the <br />vacated Right -of -Way shall vest in the owner of the adjoining property in the manner provided by <br />law. <br />Section 2. The Mayor and City Staff are hereby authorized to execute such additional <br />documents as may be necessary to evidence the vacation of the Right -of -Way herein vacated, <br />including without limitation any quit claim deed. <br />C9L ``1`I <br />
