PUBLIC COMMENTS ON ITEMS NOT ON THE AGENDA

NONE

COUNCIL INFORMATIONAL COMMENTS ON PERTINENT ITEMS
NOT ON THE AGENDA

NONE

REGULAR BUSINESS

so. 96TH STREET/DILLON ROAD ANNEXATION

RESOLUTION NO. 47, SERIES 1996 - CONCERNING TWO PETITIONS FOR THE
ANNEXA TION OF PROPERTY TO THE CITY OF LOUISVILLE, COLORADO,
KNOWN AS THE SOUTHEAST LOUISVILLE ANNEXATION - SOUTH 96TH
STREET & DILLON ROAD NO.1, AND THE SOUTHEAST LOUISVILLE
ANNEXATION - SOUTH 96TH STREET & DILLON ROAD NO.2, AND FINDING
THE AREAS PROPOSED TO BE ANNEXED ELIGIBLE FOR ANNEXATION

Paul Wood, Planning Director, combined his comments for Resolution No. 47, Ordinance No. 1220,
and Ordinance No. 1221. The areas proposed for annexation met all statutory requirements for
annexation. Ordinance No. 1220 proposed the annexation of approximately 2,000 linear feet of
Dillon Road commencing at So. 96th Street and running west, 2.29 acres. Ordinance No. 1221
annexes the balance of Dillon Road and 96th Street. These have been amended to take effect
immediately upon authorization tonight.

Davidson called for public comments.

Elmer Crider, 9355 Paradise Drive, Broomfield, Colorado, stated that John Morrison, previous owner
of this property, had told him that City representatives had told him that it would all be open space,
not developed. He asked Council to leave the land as open space. He pointed out that it lies
between the City and the hospital and the new school will be adjacent to it, being an asset to biology
classes, nature hikes, and studies, with bald eagles in the cottonwood trees. He asked Council not
to deceive or defraud Mr. Morrison who sold the land in good faith with the understanding that it
would remain as open space.

Davidson pointed out that the County bought the land, so the property owner negotiated with the
County. The City had no way of knowing what representations were made. The City bought the land
from the County.

Davidson called for Council comments or motions.

2
