<br />Sisk moved that Council refer the Pacificia PUD to the Planning Commission with Council comments. <br />Seconded by Keany. All in favor. <br /> <br />DISCUSSION/DIRECTION - LETTER OF INTENT TO ANNEX - MARTENS PROPERTY - <br />SO. 96TH A VENUE <br /> <br />Paul Wood, Planning Director, stated Mr. Adolfo D. Games had submitted a letter of intent to annex <br />the six acre parcel owned by Mr. and Mrs. Marvin Martens at 1212 South 96th Street and he wanted <br />it to be zoned Agricultural. The property had been divided into two parcels with the residence <br />located on the front 1.5 acres on South 96th Street (Parcel B), with the balance of property (4.58 <br />acres) undeveloped to the east (parcel A). The letter indicated immediate occupancy of the residence <br />upon annexation, and development of the parcel within a one to two year period. Mr. Games <br />intended to build a private tennis club, which would include indoor and outdoor courts as well as <br />clubhouse facilities. Construction would begin one to two years after annexation with proposed <br />build-out in five to 10 years. The applicant requested the following provisions be incorporated into <br />the annexation agreement: <br /> <br />1. ) Waiver of annexation application fees - $660.00 dollars. <br />2.) Waiver of two water tap fees - a I" for Parcel A ($13,550) and a 3/4" for Parcel B <br />($8,175). Staff did not support the fee waiver for a commercial user. <br />3.) Waiver of the Capital Improvement Fee for the residential unit. This fee would not <br />be assessed for an existing residential structure or the replacement of that structure. <br />4.) Waiver of the water resource fee - $1,290/acre = $7,740 dollars. Staff did not <br />support waiver of the water resource fee for a commercial user. <br />5.) Waiver of the open space dedication requirement for the residential lot only. <br />6.) The applicant was requesting that the private recreation club be specifically approved <br />in the annexation agreement as an acceptable use for the future development of the <br />site. Staff did not support authorizing the use as part of the annexation agreement. <br />The annexation agreement could specify that the applicant have the opportunity to <br />apply for a SRU to be reviewed by both the Planning Commission and the City <br />Council. <br /> <br />Davidson called for the applicant's presentation. <br /> <br />Peter Stewart, Architect/Planner, 1132 Jefferson Avenue, Louisville, Colorado, stated that they are <br />proposing four to six indoor tennis courts with a six to twelve foot berm around the whole facility. <br />They liked the mixed use of the site with the home and the facility. The applicants also wanted to <br />firm up what kind of park dedication and any roadway right-of-way that could be included in the <br />annexation agreement. <br /> <br />Adrianne Gomez, 4807 West Moorhead Circle, Boulder, Colorado, stated that they wanted to <br />establish a family run business, a tennis club, which is economically feasible for everyone. They want <br />to offer tennis lessons, clinics, playing, events, etc. to juniors, adults, and senior citizens. <br /> <br />6 <br />
