<br />Howard stated that the City had planned for the water usage by joining the Northern Colorado Water <br />Conservancy District. <br /> <br />Lathrop did not think that having a requirement that he, as a commercial user, could only use up to <br />a certain amount, even if he was willing to pay for that additional, was either necessary or should be <br />imposed, especially at this time. <br /> <br />Lathrop moved that Council adopt the City of Louisville Water Conservation Plan as presented with <br />the exception of the requirement for low water use for a commercial development, paragraph on the <br />top of page 5 and top of page 7, the word "requirement" should be eliminated in those paragraphs. <br />Seconded by Howard. <br /> <br />Simmons reminded Council that the Water Conservation Plan is in its first draft and will be amended <br />on a periodic basis as they evaluate the changing needs of the City. <br /> <br />Sisk suggested that the City go with "guidelines". He asked to have the Plan reworded and presented <br />at a subsequent time. <br /> <br />Davidson suggested that Council use the word "encourage" rather than "guidelines". <br /> <br />Sisk moved that Council continue this for two weeks and have staff get back with them. Seconded <br />by Mayer. All in favor. <br /> <br />EXECUTIVE SESSION <br /> <br />Bill Simmons, City Administrator, requested an Executive Session for legal consultation with respect <br />to pending litigation, specifically Northern Natural Gas vs. City of Louisville, et al. <br /> <br />Lathrop questioned the need for an Executive Session. <br /> <br />Dave Clabots, City Clerk, read the appropriate Executive Session statement. <br /> <br />Susan Griffiths, City Attorney, stated that under the wording of the proposed settlement there is a <br />statement that the parties will pay their own costs and attorney's fees. The intent of the proposed <br />settlement is that the City would waive any claim that it might have for attorney's fees against Bellock <br />Construction and Coal Creek Associates. <br /> <br />Davidson called for a motion to go into Executive Session. <br /> <br />NO MOTION OFFERED <br /> <br />Davidson stated that with no motion they would cover this in open session. <br /> <br />8 <br />
