<br />responsibilities for any future problems that may occur if it is considered and passed. <br /> <br />Staff Summary: <br /> <br />Paul Wood stated that Staff is recommending approval of the Special Review Use and Final PUD <br />Development Plan with six conditions of approval. <br /> <br />Applicant Summary: <br /> <br />None. <br /> <br />Public Hearing Closed / Commission Comments / Vote: <br /> <br />Commissioner McDermott asked how they currently exit and enter with only 24 feet at this time. <br />Chief Brewer stated that they have to use both lanes on Main Street. <br /> <br />Commissioner Lipton thinks this is an attractive proposal in terms of the aesthetics and the <br />architecture. He thinks it benefits the community to see this property redeveloped. He is uneasy <br />and concerned about the access issues. Neither one of the two entities has a permanent legal right <br />for the exclusive use of that road. The Fire Department at some point could only assume that the <br />adjacent property owner might need access to that road. Yet, the city didn’t give them full and <br />permanent exclusive use of that access. At this point he is not ready to approve or disapprove <br />this. He would like to see this remanded back to Staff and see if they work something out. In all <br />fairness, he does not see the Fire Department having a permanent exclusive right on this piece of <br />property. In balancing the public interest he doesn’t think he could give the adjacent private <br />property owner the use of this right without some better assurance that the health and safety of <br />the Fire Department and the people that come in and out for the purpose of the Fire Department. <br />He would like to see the parties come together and work something out between the two of them. <br /> At this time he would deny the application. <br /> <br />Commissioner Kalish also likes the way the proposal looks. She is also very concerned about the <br />safety issue and the fact that the existing conditions at the fire station are not going to last forever. <br /> Main Street will most likely become more active. She would also like to see a compromise <br />between the two parties. Does there have to be ingress and egress for the insurance agency? Can <br />there be a single lane that would fit on the property as opposed to a 20-foot wide driveway? <br /> <br />Commissioner Lipton stated that the lot line could be adjusted on the North side of the property, <br />shift the building over in order to allow more access on the South part to allow both to use that <br />piece of property for access. <br /> <br />Commissioner Pritchard thinks this is the kind of project that they would like to see around Main <br />Street. There has to be some kind of compromise and the safety issue will have to be addressed. <br /> <br /> <br /> 13 <br /> <br />
