<br />Motion made by Jeff Lipton to deny the Special Review Use for the Public Service Company of <br />Colorado. The Louisville Planning Commission finds that the requested Special Review Use is <br />inconsistent with Criteria 1 and would be contrary to the general welfare and economic prosperity <br />of the immediate neighborhoods. That the proposed Special Review Use request is inconsistent <br />with Criteria No. 2 inasmuch as the use and development will not lend economic stability <br />compatible with the surrounding established areas. And, that the proposed Special Review Use is <br />inconsistent with Criteria No. 4, inasmuch as the external effects to the proposal are not <br />controlled considering compatibility of land use to prevent the occurrence of nuisance and other <br />factors deemed to effect public health, welfare, safety and convenience. The Louisville Planning <br />Commission denies the requested Special Review Use and that the Planning Commission <br />recommends to the Louisville City Council that the Public Service Company be allowed to utilize <br />its legally obtained rights-of-way and easements as related to these transmission facilities only <br />according to their existing legal entitlements. Further, the Louisville Planning Commission <br />recommends that the City Council negotiate with the Public Service Company to ultimately bury <br />the existing facilities if economically and technically feasible. And, that the Public Service <br />Company of Colorado develop and present a proposal to the Louisville City Council for under <br />grounding the service upgrade. Seconded by Debra Kalish. <br /> <br />Roll Call Vote: <br />Christopher Leh, Yes; Bill McDermott, Yes; Chris Pritchard, Yes; Tom <br />McAvinew, Yes; Debra Kalish, Yes; Jeff Lipton, Yes. <br /> <br />Five minute recess. <br /> <br /> <br />B.Resolution No. 19, Series 2000, Peak to Peak Charter School, Lots 1 and 2, <br />Block 5, CTC, (former SPF Building) 1812 Boxelder Street, Amended Final <br />PUD Development Plan and Special Review Use. <br /> <br />Staff Public Notice Certification: <br /> <br />Paul Wood, Planning Director, certified that public notice was published for this hearing in the <br />Daily Camera on Sunday, May 28, 2000, and mailed to surrounding property owners and posted <br />in City Hall on Friday, May 26, 2000. All Planning Commissioners verified that they were <br />familiar with or had visited the site. Commissioner Leh does have a conflict of interest and <br />excused himself from the hearing and from the room. <br /> <br />Staff Report of Facts and Issues: <br /> <br />Mr. Wood presented the details of this matter as stated in the Staff report. Mr. Wood stated that <br />due to the considerations of timing, Staff has extended a timeline to the applicant which provides <br />for June 13, review by Planning Commission and if the Commission takes action either to approve <br />or approve with conditions, or deny, Staff will attempt to put the application in front of City <br />Council on June 20. <br /> <br /> <br /> 7 <br /> <br />
