Leh is pleased with the resolution as prepared by the staff.

McDermott had comments to the Mr. Hunter and Mr. Waldman. He commended the staff for the
all the time they have spent in preparing the resolution. He does request an addition to ‘o’. He
would like to see ‘explore burial of line on the existing route’.

Lipton wants the record to show that there is no mention of east/west or north/south. He also
wants Council and Xcel to work out a situation that is win/win. Based on the SRU criteria he will
vote in favor of the denial because it does not meet the criteria.

Kalish thanked the members of the community, staff and Diehl for all they have done. Also wants
language in the resolution to recommend burying the line and encourages Xcel to work with
Council to find funds for the burial of the power line.

Pritchard is not convinced that Xcel has not met the SRU criteria. Electricity is important for
economic prosperity. He is opposed to the motion.

Commissioner McAvinew states that alternate routing is not feasible.

Hearing no other comments from Lipton requested a motion.

Leh moved and McDermott seconded the passage of Resolution No.1, Series 2001, with two
changes: 1) be sure PSCo is referred to as Xcel and 2) the wording for burial of the line be added
to item ‘o’.

The motion passed with a roll call vote of 5 yes and 1 no. (Leh, yes; McDermott, yes; Pritchard,
no; Kalish, yes; McAvinew, yes; Lipton, yes; Thompson, recused)

Lipton declared a 3-minute recess.

Resolution No. 2, Series 2001
, Final plat for a 2-lot residential subdivision, Alvin and Julia
Fischer Subdivision, a replat of Lots 8, 9, 10 and 11, Block 4, Acme Place. Case #00-059-FS.

Lipton read the above Resolution and requested staff public notice certification.

Staff Public Notice Certification:
Ken Johnstone reported the public notice was published in the Daily Camera on December 24,
2000 and was mailed and posted in City Hall on December 22, 2000.

Lipton asked for any disclosures. Hearing none he asked for the staff report.

Staff Report of Facts and Issues:

5
