<br />Following up on a topic introduced earlier in the meeting, Mr. Light defined conflicts of interest based <br />on the City’s Code of Ethics, as reflected in the HRC. He explained the procedure to follow for the <br />Commissioners in the event a conflict of interest or a possible conflict of interest is identified. Mr. <br />Light provided examples of potential conflicts of interests for the Commission’s discussion. <br /> <br />Mr. Light discussed recent federal legislation applicable to the City, in particular the Religious Land <br />Use and Institutionalized Persons Act (RLUIPA). Mr. Light explained that the regulations prohibit <br />land use regulations that impose a “substantial burden” on religious exercise unless the regulations <br />further a compelling interest and are the least restrictive possible. He also emphasized that the <br />regulations specifically pertain to land use regulations that allow for an individualized use assessment, <br />such as SRUs. <br /> <br />Mr. Light explained the City’s newly adopted Home Rule Authority, as it relates to the Planning <br />Commission. <br /> <br />Mr. Light briefly reviewed liability as it pertains to the Commission’s actions on land use applications, <br />including a discussion of “Takings Claims”, and the criteria for establishing the basis for a regulatory <br />taking. <br /> <br />Land Use Entitlement Process <br /> <br />Mr. Johnstone reviewed the full land use entitlement process that brings applicants before the <br />Planning Commission with various types of development applications. He summarized the Staff level <br />work that occurs between applicants and City Staff prior to the public hearing process before the <br />Planning Commission and City Council. More specifically, Mr. Johnstone discussed the pre- <br />application processing, the internal “referral” process and then the formal recommendations made by <br />Staff through the Staff Report presented to the Commission. <br /> <br />Long Range Planning <br /> <br />Staff distributed a graphic timeline illustrating schedules for several long range planning projects that <br />will be worked on by the Commission during 2002.
