All Planning Commission members are familiar with the site. <br /> <br />Staff Report of Facts and Issues: <br /> <br />Ken Johnstone stated that this is not being processed as a PUD because the activities do not <br />constitute “development”. There are no physical improvements to the property being proposed <br />and the structure is a temporary structure without a permanent foundation. Mr. Johnstone gave a <br />brief description of the details of this matter as stated in the staff report. <br /> <br />Commission Questions: <br /> <br />Commissioner Lipton asked at what point when doing a Special Review Use would it be possible <br />to call it up and ask for another review. Mr. Johnstone stated that you can only call up the SRU if <br />it were out of compliance with what was approved. If there were a new Comp Plan that <br />recommended that the zoning be changed or an overlay zone adopted, and this use happened to <br />become a non-conforming use, the use would be grandfathered. However, it is possible in a <br />zoning ordinance to have an amortization period whereby nonconforming uses at some point in <br />time would lose their grandfathered status. <br /> <br /> <br /> 3 <br /> <br />
